JPF1715: I agree with confiscation also in the blatant life/limb situation. I have no use for drunk drivers on the road either. This law just seems to give way too much leeway on the governments ability to confiscate citizens property which I feel can and will lead to abuse. It is along the lines of the drug confiscation laws that makes property "guilty" of the crime. As we all know property has no constitutional rights therefore no 4'th amendment protection. It then becomes a civil case where burden of proof is a much lower standard. All the government has to have is "suspicion". In the so-called "War on Drugs" billions of $$$ is seized every year with the intent of the criminal paying for his own prosecution. In some/most instances these funds are not held to the same accountability as taxpayer funds and abuse has occurred. The government holds the property as hostage and the citizen has to "buy" it back. This is true even with no conviction, and conversely there are cases where the real criminals pay there way out of lengthy prison terms. Whether you believe the validity of the ACLU's claims or not I have seen other news articles (along the line of 20/20, 48HRS, etc.) that have reported these abuses. This confiscation of vehicals seems like another trip down that road.
If the government is going to special extremes to circumvent the United States Constitution then it's probably really not in mine or anybody's best interest. I tend to view the Constitution as the most incredible document ever composed so I get a little fired up when government/politicians/people trample on it in a futile attempt to feel more secure. Like the quote says, "People who give up freedom for security have neither."

I knew a gal in California, who was from San Antone, and she related to me a somewhat funny story:
She had a brother-in-law who was/is with the SAPD. He hated wearing his vest, but for what ever reason, he wore it (don't know if your department requires it or makes it voluntary). Anyway, he got involved in a situation one evening and took a round in his vest. Bullet skidded around the vest and into his wallet and finally his butt. He's religiously worn his vest ever since and stopped carrying a wallet in his hip pocket. I guess he had credit cards and who knows what else shredded into his cheeks

The vest are hot as hell, I can ring the water out of mine almost every summer day..alot of officers dont wear them because they are hot and uncomfortable...I have always wore mine (not mandatory), my thought are the bullet has got to be much much hotter.......Had a narcotics officer take a shotgun slug in center of his chest, wearing a vest with a shock plate, he shot the bad guy in the head and continued running through the house till the ADRENALINE wore off, shock plate was bent in half, had a hell of a bruise, but he went home to his family......I will always wear mine, I have a son to raise, and I will be here to do it....Dave

Concerning seat belt use, do I leagally have to wear mine in my one ton? I have asked 10 officers and gotten 10 different answers. My girlfriend says Sept 1, 99 they changed the law again. So what is it? BTW, I do wear mine in the rain to keep from sliding across the wet seat! Thanks

1. Same code 40 years ago. Sure gets your adrenalin going when you hear that over the radio. Answers some of the questions about police cars speeding with no lights/sirens as a lot were non-code calls. Despatchers got excited I guess.

2. Dirt Bike Dave. Actually, this is a lot of fun. If folks are willing to listen, there is a lot of good discussion to be had here without the need to flame each other. I had a lot of interesting experiences, which were followed up by a lot of contacts/interaction with mostly federal types especially when I lived overseas for many years. This will sort of come out if the threads continue.
Has bloody all to do with trucks, but then most of the General Interest topic stuff doesn't have much to do with trucks anyway.

GTT1, 1 ton, no you are exempt.....but I can tell you alot of officers dont know it.....so let the officer know to look in 545.413 it states passenger car or light truck...defines them as manufacturers rated carrying capacity of 1500 lbs or less...the seat belt laws do not include 1 tons..or even 3/4 tons.......Dave

Just for insight as to what I do when traveling to the deer lease or to the range:

If carrying a handgun, I always put the trigger lock on, and lock in in it's case. It's sit's in the front seat on the way to the range and is usually packed in my bags when going to the lease but alway double locked. Ammo is usually in the glove box when going to the range and packed in the same bag when going to the lease.

I've been pulled over once an the way to the range and immediatly told the officer that I had a gun in the car. It was in the passenger locked away as stated. i explained where I was going and he plainly asked me to step out of the vehicle for his safety and mine. I was let off on a warning and also thanked for immediatly bringing the gun to his attention. (IMHO) Keeping it double locked with the keys on the same Key ring as my truck keys, there is no possible way I could ever get to the gun load it (ammo in glove box) and provoke bodily harm in this manner. I don't have a concealed handgun liscense and don't want trouble. (IMHO) this seems to work best for me in my situations.

Do you agree with the way I handle my travels or do you recommend something different.

BTW - I carry my rifle the same way usually on the floor board in the back - most of the time bags are packed over them. Never been pulled over in this situation but again I would advise the officer they were there.
