Sorry I just have no respect for people that blow stuff way out, you can not compare underage drinking to stealing a car.

FYI I am 20 and its saturday night and I am getting ready to go to the bars with my friends tell a party comes up so we can also drink there, and tomorrow is drunkathon 07 at my friends house so you know there will be drinking there too. Maybe while were all drunk we should go steal a car too since they are on the same level you know?

untill November 7th, which is my court date, which is ben my penalties begin.

so im taking my sweet time i have left.....

No, it's the one that comes with a quart of Motorcraft 15W20 formulated for Powerstroke Diesel Engines. They really jipped me out on that one. But nonetheless, it's mMm tasteyyy!

I didnt take time to read any of the post really since Im sure its a buch of shlit anyway, but let me get this straight.

You HAD been drinking. You were at a football game, in the bathroom, with no keys, and weren't anywhere close to a vehicle, and got a DUI???

I hope to God your fighting (or tried if its over by now, like I said, I didnt read) that charge like a motherfuggin monkey on crack.

I would have told that cop to shove it up his azz and walked away, serious

Ahhhh, make a little more sense then.

I dint think you were possessing any alcohol though...

Losing a liscence is a damn steep punishment for a first offence MIP.

I think its a slap on the wrist and you throw 150 bucks at their face here in NE and call it a day.

An mip wont take your license away. You pay a ticket or do community service. Probation for 90 days.. And an AA class..

V.T.C.A. ALCOHOLIC BEVERAGE CODE

106.05 Possession of Alcohol by a Minor

Texas Alcoholic Beverage Code, Sec. 106.05 provides that a minor (a person under the age of 21 years) commits this offense if he possesses an alcoholic beverage.

A minor may possess alcohol if he is in the visible presence of his adult (over the age of 21 years) parent, guardian, spouse, or other adult to whom he has been committed by a court.

A minor may possess alcohol while in the course and scope of his employment if he is an employee of a license or permittee and the employment is not prohibited by this code.

This offense is a Class "C" misdemeanor punished by a fine not to exceed $500.00. However, if a minor has 2 prior convictions, the punishment is a fine of not less than $250.00 or more than $2,000.00 and/or confinement in jail for a term not to exceed 6 months!

The court shall order a convicted minor to perform community service for not less than 8 or more than 12 hours. However, if he has a prior conviction, the community service is not less than 20 hours or more than 40 hours.

The court shall order the Department of Public Safety to suspend the minor’s driver’s license or permit or, if he does not have one, to deny the issuance of one for: 30 days if he has no prior convictions; 60 days if he has one prior conviction; or 6 months if he has 2 prior convictions.

For the purpose of determining whether a minor has a prior conviction, an order of deferred adjudication for a prior offense is considered a conviction!

The court shall require a convicted minor who has not been previously convicted to attend an alcohol awareness course approved by the Texas Commission on Alcohol and Drug Abuse. If he has been previously convicted, the court may require him to attend the course.


The word shall indicates a directive and is not optional.

And the definition of MIP is somewhat vague and is open to interpretation by law enforcement agents. Read on.


Minors are at risk of an M.I.P. citation anytime they go to a party, nightclub, or when they are in a vehicle where alcohol is present. A minor can be in the proximity of alcohol which belongs to another person, but cannot touch, hold in his/her hand, transport, attempt to purchase, consume, or have any contact with it.

Possession of an alcoholic beverage may also include situations in which there is "constructive possession." An example of constructive possession is when a minor is in an automobile where alcohol is readily accessible to any minor passenger in that vehicle. This situation extends to alcohol which is on the car seat, floor, or stored in the trunk of an automobile in which the driver is a minor and is in possession of the keys which unlock the trunk.

Constructive possession may also exist when:

1. you are at a table with several people who are drinking from a pitcher of beer with cups scattered about;
2. you pick up empty beer cans and cups;
3. you hold a friend’s beer so that they can put on their jacket; or
4. you use a beer can a spittoon.

Furthermore, a minor will be considered to be in possession of alcohol simply if he/she is carrying a grocery bag for a friend in which alcohol has been packed.

You can take that another step further and say there is nothing wrong with stealing someone's truck. I didn't hurt anyone. Their insurance company will cover it so they aren't out any money. It's a law...you break it, it's wrong. You know what the punishment is before you do the crime (at least you should...if you don't, it's your own fault).

you tell me why it's against the law. What harm is being done?

i dont care if my licensde gets suspended i know i did wrong and got caught, i jsut dont want it gone for a fricken year.

I just read this thread, Man this brings back memories... It was 1982, and I was a senior in a Catholic High School. My friend was from the other school we were playing that night (Football) We had 4 J.V. Cheerleaders with us and we had been drinking a few before we got to the game. There was no parking spots, so i was driving a 78 Jeep CJ-7 and i decided to park on the grass. A cop busted us after we got out, and looked through the window's and spotted an un-opened 6-pack sticking out from under the seat. He asked the principal from my school if he wanted to handle it, or do you want us to, He said that he would handle it. He made us call our parent's, put none of them were home, but we did get a hold of his sister, and he told us to go home and that he wanted our parents to call him first thing Monday morning. I asked if i was kicked out of school again, and he said yes. I then lit up a cigerette and said "F" it and left.... Man they sure wouldn't release you on your own like that these days.... Good luck Pat, you will look back on this in the later years and laugh while you are telling your kids how bad you were...
