I ama highway contractor for the state of Texas and we are 100% liable for traffic control and repair to any damage. You need to file a lien with the owner of the highway or street. IF a lien has been filed than they can not pay the general contractor until the lien has been resolved. BY them agreeing the pay for $125 worth of damage they admit guilt, therefore you can make them buy a new tire, and what ever else. In texas it does not matter what happens, if an idiot does drive through our cones and into our paint we still have to pay for it because we are responsible for traffic control...

Wow, great thread! Sorry for all this happening to your truck, but man this was a good read.

Did they get all of it off of your wheels?

I would still file a lien, as kelly posted. He's right, they have to satisfy the lien, but at most you have 30 days to do this, maybe less if it was a sub. You may be able to download a lien form from your governments site. You'll need to file it at the court house.

Thanks guys, can't find anything regarding on filing a lien on my county's website however (http://www.forsythco.com/).
Punisher: yes it is all off my wheels. The back tire still has paint on it thought that seems to be coming off slowly but surely. And there is still paint on plastics. I.e. Mirror cap and door handle and inside wheel wells.

That sucks.... A long time back I used oven cleaner to remove some air brushing I had had on my old mustang. It worked well and didn't harm the body paint.

That's not as bad as mine was...My Silver '10 F150 got covered in yellow and white...the whole damn drum fell from the truck, hit my hood, busted windshield, and covered in paint. The company paid to have my truck replaced w/ OEM parts and total repaint, new wheels and tires...they almost just bought me a new truck. They paid for the rental truck for all last month. My truck is just like new now.

Sounds like they took good care of you Bevis, although has to be a little scary having a paint barrel hurling toward you.
