I dont think it matters here. He killed 6 people. Did he not? Accident or not, 3rd degree murder is manslaughter. Its not intentional, but you still did it.

 

Seriously, wasn't there a vehicle malfunction where the throttle was stuck WOT? Well since I'm sure he has a crew who works on the vehicle as well as a pit crew chief, why don't we make them responsible too for this accident !?

 

He'll get his day in court. A jury will decide if it was a driver malfunction.
