F-150 vs Kia
So I'm leaving work for a nice long holiday weekend last Friday. I pull out of my parking space, get ready to shift into drive and into a fun-filled weekend and BAM!
There is a smushed up Kia behind my bumper. But not only was there a Kia on me, the driver was a girl I just hired that same day.
Picture a square parking lot with spaces around the perimiter and aisles in the middle. I pull out of one of the perimiter spaces, stop and get ready to shift. She came down one of the aisles, did a rolling stop, only looked to the right and proceeded to go left. I was on the left.
She said she was sorry, it was her fault, etc. Company security came out, they called the cops, etc. Cop takes our statements and says, "I'll let the insurance companies fight it out." Gee thanks Chief.
Before we leave, it was just her and I standing there. I offer her a ride (Her hood folded like a tent.) and she says her friend is here to take her. Then she says, "I told him it was my fault, I don't know why he didn't say so."
Well, today I talk to my insurance company and she says it was both of our faults. I flipped. I then calmly asked her, why did you say what you said? And she said, "I talked to a cop I know and he said I have the right of way since I was already out of my space."
Can you sense my blood pressure going higher? I re-told her all the events and what was said and said I would have appreciated the right story being told to the insurance companies. She claimed she would reconcile that with the insurance companies. But we will see. I could get into nitty gritty details, but this post is long enough without them.

I'd fire her, and before she could accuse you of trying to get even you could tell her it's because of her dishonesty.

Depends on the state laws because here if you rearend someone, then it's automatically your fault.

a rear-end collision is never automatically the rear cars fault. What if you are driving in a straight line at posted limit and a parked car just pulls out in front of you and you slide into it? If that were the case then people could just pull out whereever and never use their mirrors.
The whole situation is how much time she had to apply her brakes before she hit him.
I was out of my perimiter space and stopped. She came down an aisle, didn't stop or look left, the gassed it making a left turn and ran into me. Totally her fault. I didn't pull out in front of anyone. She just didn't look or stop.
Fortunately I have our conversation regarding her changed story, documented through an e-mail. Hopefully that'll count for something.
