FORD's POWER LEASE LAWSUIT? thoughts, you entered contract relying on Gen 3 Lightning

Perhaps Tim Skelton can Chime in on this..

As I understood it, Ford offered a POWER LEASE for individuals to buy current (heritage style) Lightnings and Cobras, so when the new ones came out they could trade "up" without penalty. Ford did this to assure the Heritage style Lightning and the current cobra (don't know it's technical name) would move of dealer lots.

If anyone has one of these, could you SCAN IT AND POST IT. I would like to read it. I don't care how long it is. I want to read the small print.

Here's my thought.
you signed a contract under the promise that Ford would deliver a new vehicle. Basically you detrimentally relied on Ford's Promise to you. Now they are breaking that promise.

Is this actionable? I don't know I'm not an attorney.

However, perhaps it is another avenue to "pursuade" Ford to Keep it's promise.

I don't have Tim's E-mail but could someone get ahold of him and have him chime in on this thoughts? I'd LOVE to know what he thinks...

I still have in the back of my mind that Ford is only doing this to raise hype about the new SVT vehicles, basically just a marketing ploy, but everything I read is to the contrary. Perhaps I'm clinging on to a dream...

I was thinking the same thing. My thought is that they haven't renigged on the contract because they haven't had an official Ford press release saying the L is done (this is based on the thought that there is no garunteed date on the contract for the date of the proposed "upgrade").

What does the "power lease" truly state? Is it open end? Did Ford agree on the lease to bring out a Gen III by a set date? I doubt it.

I bet the "small print" includes a disclaimer about the possibility of delayed or cancelled production of said vehicles voiding the lease.

Here is my thought about it, and I am not attorney either. I looked into the Powerlease when I bought my truck back in May, and as I understood it, there were only two differences between it and a regular (Red Carpet) lease:

1. You were put on the waiting list for a new Lightning/Cobra and pretty much guaranteed one when they came out.
2. Your lease term was set at around two years, but adjustable based on Job 1 dates for the new SVT vehicles.

So, since the new Lightning is (allegedly) not coming out, you are guaranteed nothing. The only issue is when the lease expires...there is a set lease end date in the contract, and that would change only if production was moved up or back.

In a nutshell, they didn't promise anyone a Gen 3 Lightning (or Cobra) when they gave them the Powerlease. Just like no one promised to buy one when they signed a Powerlease. Ford simply offered first dibs on the new ones, along with a more flexible end date. I am thinking it's probably just a regular Red Carpet lease now.

I have no idea, Menace. I think that the analysis would depend on exactly what was promised (which is I'm sure why you asked for a scanned version of the agreement).

But from a lay perspective, I would be f'in hot if I were in one of those leases right now. Ford in essence lured people away from other alternative purchases/leases by writing a check that they now can't cash.

BTW, that quote from me is savage. Damn I was in a bad mood (meant every word of it, though).

You can wait until you get bored with it.

But it is a little ridiculously long, which is hypocrisy by implication/irony from the "trim those sigs" guy. Maybe trim it down to:

"I am convinced more and more each day that the average Lightning owner's IQ is about room temperature -- measured in Celcius.

The only thing that has kept me here as long as I have is the few people who actually understand the scientific method -- or at least can spell it."

I gotta admit, I laughed out loud when I (re)read that.

Mr. Skelton: I do understand the frustration which leads to your increasing distance from the board. But each day brings a new crop of posts ranging from the inane to those which truly add to the data base. But that is how a public forum works. I it any different than day to day life? If you have the enviable position of spending every day in the company of those you consider to be intellectual equals, I'd like your job. But somehow I think immersion in the depths of the People"s Republic of L.A. has left you convinced that the norm is somewhere below room temp in IQ. But you have knowledge. And that knowledge can solve the problems of others. Yes, Tim, we could be driving F-40's. But do you honestly think there is an F-40 forum? No, most F-40 owners are posers who are very skilled at giving the key to either the valet or the service manager. But not so the F-150 group. These people actually get their hands dirty working on their vehicles. No, not all of them, but many do. And I really and truly respect that! But like yourself, I surely got annoyed with people like LightningGuy, a troll who has, for what ever reason, left the board.

The idea of owning a "pickup truck" because it was fun to drive was a true oxymoron for me. I've owned them to haul things home from the store and to tow boats. But for the price and enjoyment, I find my 2003 Lightning to have a greater return for its cost than anything I've owned for years. The hours I have spent on this forum have made it all the more enjoyable because I've been able to profit from the experience of others. So, I'll soldier on, gleaning what gleaming tidbits are offered when they appear. And, in turn, I'll offer what I know in return. That, kind sir, is what makes a teacher, a calling which I know you understand.

So please bear with us. It is a lot easier than being married....

And it is an enjoyable diversions from tilting at windmills of everyday life.

L-Menace,

Is Mr. Skelton your hero? If so, I suggest the first thing you learn from him is correct spelling and grammar.
