I'd really push for the Ex post facto angle and make a BIG deal about it. I'm sure you can find incidences of people who were involved in a scrap in the past and now hold say public office and still own guns <cough cough>. Never underestimate a well written letter to the Editor of a local rag.

It was "battery".

At the trail, the judge sentence me to 30 days in jail, and then suspended it. I was put on 90 days probation, and ordered to pay $265 doctor bill.

This is the sticky point. It is punishable up to a year. And that is the reason, along with the Brady Law, I am being refused.

Make sure you read reply # 218 and 219 on page 15 then.... might even want to print off all 28 pages and highlight the appropriate parts.... As far as I can tell (and unless there's something else out there I'm not aware of) you should be entitled to it back. The law only prevents you from taking posession for crimes punishable for greater than one year...

Those convicted of crimes punishable by imprisonment for over one year, except state misdemeanors punishable by two years or less.
By my read, unless your state misdemeanor was punishable by more than 2 years, you're entitled to get it back.

Might be time to contact an NRA attorney on the case....

Nah the FX4 model... Looked into the king ranch. But that interior looks like alot of work... lol

and to quote the Brady Law:
"Those under indictment for, or convicted of, a crime punishable by imprisonment for a term exceeding one year;"

It doesn't matter if you pled guilty, no contest or had the record expunged or what punishment you actually received. When you received it is also irrelevant as Brady is retroactive to the beginning of the universe. If the law in your state says the max penalty for battery is 12 months or greater the mere posibility of receiving that 12 months+ disqualifies you from ever getting a gun again via the regular dealers network. (Or from the cops)

Ironically there were a bunch of cops that lost their job because of that little law. If you can't have a gun you can't be a cop.

Wrong. There was a case several years back that ruled in favor of the non felon resident of the house. I'll look it up if your interested.


And a misdemeanor conviction is not a felony.
I would like to see that case. I know this from a friend of mine who was specifically told by the judge thatthere would be no guns in the place that he resides, or his azz was inda slamma!

FYI... As a lifetime member of the NRA since I was six years old, and an owner of various sporting guns, avid hunter/shooter and an avid gun collector....
I most definatly take my right to own all these guns very personally and very dear. It's going to be something fairly major before I feel the need for ANYONE to not beable to own a gun if they wish.
But... if by any chance... under any circumstrance... any of them was no longer in my posession against my will and the where abouts of them were unkown......
Then yes, those things most defiantly would be the first things running through my mind. (even pre-registration) I don't know.. maybe call me responsiable. But I do hold myself accountable for my belongings. Might even call me a control freak! If I buy it, then I am in charge of it. If I am in charge of it, that makes me accountable for it. Can you give me one good thing that a gun stolen or bought on the black market was used for?
I can see being called any of thse things, (Responsiable, accountable, control freak) but moronic???? You'll have to explain how you derived to that conclusion.

Why only sporting guns? You do know that 'sporting purposes' is complete and utter bovine scatology and that duck hunting is not the intended purpose of the 2nd. Right? Everyone sohuld have an AR or 12 and a esss kay ess.
