Geez, I hope the lady that hit you is OK. SHe picked the wrong vehicle to hit in that little car.

If the damage is that bad, maybe the insurance company will do a substitution of collateral (they'd replace the vehicle with one exactly like it and just "substitute" it on the loan). Sounds pretty bad so I'd push for it, and make sure whoever you financed it through knows as well. They have a vested interest.

Goochy,

Take this advice in the right spirit: GET or CONSULT a lawyer. It will be in your best interest! The insurance companies will try to low ball you.

As a side note you may consider GAP insurance on your next vehicle. It is supposed to cover the GAP in what you owe and what the insurance company gives you in the event you total the truck. The finance guy told me about it when I closed my loan.

Best of luck to you and your wife. What lies in front of you is not going to be fun!

Marc

Going over blind hill, WOW!!!!!!!!!! she was coming at me in my lane, I tried to hit the ditch, but she kept coming. Small county rd, lucky my truck went though someones yard, missed some trees, then went on the side of the road embankment. We hit doing 50-55 , NO brakes. I keep asking myself why?? What could I have done different?, but I really think I did the right thing, I tried to miss her. I almost did. My ft bumper under headlight hit her, so she got lucky I turned to the right , and not straight. I would have killed her if I did not turn away from her. Going to talk to insurance, police, doctors, today. I found a 2002 white I like NEW... Also found a 2003 red same truck, with the sport package on it. I will get a new truck again, somehow. I will not keep my old big red

Hi Goochy

Sorry to hear about your accident. From the way you describe it its amazing no fatalities.

Wonder what reason lady had for driving on wrong side?

Not sure on brakes..with ABS...should still have brakes...maybe did and just skidding etc in all the excitement felt like you didnt?

Anyhow...glad you and yours walked away.

Good luck...OT

I'm telling you, that thing is new enough, with that damage, they should take the equity and transfer it to a new truck. Unless you had tons of miles on it, it should be considered "new" and replaced with "new". Auto finance companies refer to it as a "substitution of collatoral", that is they substitute the truck on the note, just change the VIN and description and have the dealer give you a new truck.

Goochy--go and get checked out regularly, from the doctors, But here is a tip, dont settle medically untill you are absolutely sure both of you are ok...Some people say not to settle for 6 months, in case any other medical problems come up....

Good luck, and get well...

Now I have two insurance companies looking at my truck. Lady who hit me only has $10,000 on coverage . So not enough!! Now my insurance company is involved. I hope they total it!!!!!!! only has 1200 miles , and NO payments made so far, due Nov 25. I think frame is bent, it took a hard hit!! Ft axle broken, rim broken off truck, transfer case blown up, transmission busted, 3 tires, 2 rims, bumper, hood, windshield, 2 air bags, 2 doors, rear panel small dent, nerf bar broken off, truck looks ok, until you look under it, its all broken. if wheel did not break off it would only be sheet metal damage. Is it totaled?????? Truck cost $40,800 sticker, owe $32,??? how much will I loose if they total, or fix?? I will NEVER sit in this truck again, buying NEW 2003 , as soon as possible. If they choose to fix it, I will refuse and sell it for salvage myself, and keep the check for the repairs. Most of my friends, and local shop looked at it, they all say it will be a coin toss??? total?/ repair? They all said atleast $18,000- $25,000 to fix it. I will find out Wed. , so wish me lots of luck!!!!!. The 2003 I have picked out will list for about $42,500 Sport F 250 and I will get X plan price agian. I start back to work Wed. so they have to pay for my doctor bills, time off from work, and if they do not take care of me, by giving me like $40,000 or more , I just might go for the OLD , pain and suffering !!!!!!!!! SUE!!
