Unhappy Smashed my new truck!!!

Well yesterday I was at work flagging traffic and my truck was parked at the curb about 20ft behind me. I went over to the cooler in front of it to get a drink and heard something and went to look up and all I saw was the grill of my truck coming right at my face! Some guy was pulling a trailer with a smaller kubota track-ho behind his one ton and had a 2" ball and hooked a 2 5/16" trailer to it. The trailer came off and was barreling down the road and smashed into the back of my truck, my truck hit me and threw me, then hit a light pole and the trailer spun around and smashed in the left side of my truck. When the truck hit me it was in the air because there were no skid marks from the spot my truck was parked. The tow hook hit my leg and smashed the hell out of it which is making it hard to walk right about now, other than that I consider myself blessed to the fullest extent that it did not run right over me. I believe the truck is totalled because it crushed the drive shafts and pushed the whole rear end a few feet closer to my cab. Plus the front of it was smashed by the light pole and the passenger doors were smashed into the cab. It was not a brand new truck but was new to me and I had not even paid the first payment on it. Im hoping that I can make the company responsible pay for me to get a new F250. Anyway just thought I would share what happened, it was a really crazy freak accident.

Glad to hear you are ok. Sucks that your truck is totaled before you even make the first payment though.

I'd dang sure be getting ready to sue for anything insurance doesn't cover.

Anyone that's mechanical savy enough to need a 1 ton truck and a tack-ho is dang sure going to know trailer ball sizes.

Sorry about the truck, but this scenario sure as hell could have turned out worse. Amazingly, you came out of this relatively unscathed. Glad to hear it.

Did the police, or your states version of the DOT respond to this accident? Talk about a load security issue here, or at least negligence on the operator/drivers part. I'd hate to be receiving the charges that this driver should be, based on what you've said anyway. Again, in the drivers case, he should be happy because those charges could be a lot worse, if a death was involved.

Either way, the news could have been a lot worse. Glad to hear you're okay.

.... and on top of what I said, did the trailer not have a secondary means of attachment (safety chains, cable, etc) that would have held the trailer if the ball/hitch came undone? Wow!

WOW! Glad to hear you are OK...that's the important thing. The rest can be resolved later if you are still alive and kicking...even if you can only kick with one leg for now.

wow... that sucks...

I am NOT for frivolous lawsuits... but I think you are justified in going after the company that owned the truck/trailer for the money to buy a new truck. And I would get enough to buy a brand new F250 Diesel if I were you (Twin superchargers!!!) If they balk at the upgrade, mention that you could instead have your lawyer sue them for all your personal pain and suffering. They showed blatant negligence in not using the proper equipment and not using chains on the trailer.

Hope you are feeling better!

A lady was driving by when it happened n called 911 right away. She had a lil 10 yr old girl with her that was cryin her eyes out (kind of made me feel bad b/c I was cussin like crazy as u can imagine). It was the last day on the job for the driver. The passenger of the truck told him something was wrong with the trailer n he wouldn stop til he realized it was gone. They had safety chains on the trailer, but they snapped or were not hooked properly. I am not sure but my boss, my brother, and our mechanic looked over everything real well n took a whole lot of pics.I am not goin for a bunch of money or anything but this was a very big company and they had a retarded *** driver in my opinion n I will be going for them to pay off my truck and buy me one of my choice. They do that and pay my dr bills and I will be happy.
