Um, California. Minors are never responsible for their actions. Even if they were, the maximum sentance is 'until they turn 18' even if they kill a dozen people. Very progressive state...

So I went and got quotes. Highest was 2600, lowest was 1500. So I go to the mobile home park to give them a chance. I call her, she picks up and says the third party won't pay. So I said I'd call right back, so I call back and she doesn't pick up. I call about 3 times no answer, go to her door, no answer. I leave a note saying I appreciate her wanting to help, blah blah blah to call me.

So I called just a minute ago, her daughter picks up, "This is her secretary, let me have her call you back." She's playing games.

My question is, how do I take 3 parties to court, I need your advice before I go in there without the information needed. If I take 3 parties to court I'm going to go with the $2600 quote so I get my court fees back and time. This is bull****!

Talking file a lein against the property

Anyone can file a lein against someones property, assuming they are the title holders. If not the home, then go for the car.

What if the property is rental, and their car isn't even worth the damage? It's a mobile home park and their home is not the nicest on the block...that really says something. If it's still possible how do I file a lein against their property. She does not have homeowners insurance and when I questioned rental insurance she said it will not cover that.

The incident is inforgiveable, nobody deserves large rocks thrown at their vehicles on the freeway. I can't just suckup a couple grand in damages when I'm trying to sell this, life can be far too unfair. The way she is handling this, I wish she was put in jail over her kid. She was a complete kissass to the cop and me when it happened swearing she was going to punish her kid if he didn't take him to ju-v, and now she's having a laugh behind the curtain when I get there.

Man, you are lucky. That happened here in VA and the rock crushed the car and put a lady in the passenger seat in the hospital for close to 3 months. She suffered some pretty extensive injuries.

Another story about this

On how to take them to court, you shouldn't have any problems there. In fact, all you really need to do is press vandalism charges, the state will take it from there, and it shouldn't cost you a dime. I had a similar situation happen to me and the state took the individuals to court and they were forced to make restitution. The bad part: you get your money in installments as the person pays the court clerk.

Josiah, have you talked to the attending officer and told (him or her) your getting the run around... if there was an agreement between the officer and parents to take care of the damages... and its not being done.... it still may not be too late for the rock chuckin SOB to be fitted with a shiny set of silver braclets.....
she may hide from you, but inless she is pulm dumb, she will deal with the officer....

I remember this, only about 40 miles from me.....

That video was hilarious, I feel terribly bad for the lady but the man just killed the dramatic side. None of the rocks they through were 70lbs (obviously), the ones on the freeway were about 15-20lbs, the biggest was the size of a human head and I have no idea how much that weighed. The boom was very masculine, very bassy and had substantial weight, at 60mph it sounded like a boulder. The truck who was hit in the windshield was terribly lucky.

This is great advice and I commend you guys for coming through when I need it most. I will fondle the idea of vandalism charges but I will 100% press charges if I do not receive the money in full. I will take this to court by the end of this week if they do not pay. I am taking notes of the times and dates I call and what took place when I did. There are witnesses (their manager for crying out loud) that I made the calls.

F150truckin'- My mother has been a dispatcher/supervisor @ the local P.D. for over a decade so I am trying to get an officer to follow me over there, even though they refuse to deal with civil cases. This is also out of their jurisdiction (right on the borderline anyway, CHP took the case but both attended).

So my options: Go to the court w/their names and locations, police report and ask to press charges (is this all I need btw). Also entertain the idea of vandalism charges. Anybody else have anything to add before I take the trip to the courthouse? The vandalism charges sounds like it will take some time to press and definitely a while to receive compensation but a good option nonetheless. It's up for sale so I'd like to keep that in mind (I'd like compensation within the next 2 months if possible). What a welcome to the court system.

I can see them not wanting to get involved and refuse to deal with civil cases, but I may be wrong, throwing a large rock at a moving vehicle would seem to be a criminal charge to me..

destruction of personal property with intent to do bodily harm..

I know here in Chesterfield, Va.. someone would be in the nice new state of the art JAIL just was just built.....or the detention center depending on age.. no questions asked...

You may not be able to file a lein. There are only certain types of leins (at least in Texas) Only for money owed for work done(mechanics lein) or overdue taxes, (Tax Lein). I havent been following the whole link, but do you have a police report? If so, you could file civil suite and if they show up, your sure to win. If not they should issue a warrant. If not I would consider it a lesson learned and get a police report next time.

Josiah, just go to the local court house with the police report number, her name and contact information. Tell the clerk you wish to file a suit in small claims court and explain your situation. They'll set you up with a small claims case and the state will represent you. She gets called to court and if she doesn't show they issue a warrant for her arrest to bring her in.

I'm next to positive you can't just file a lien against title in any state unless backed taxes are owed to the state. My sister is a lawyer and I went through several law classes myself so I have some credibility on the subject.

Hope it works out, and get the claim filed fast as you only have so long to file in some states. If you wait too long you won't have a case.

I hate to break it to you...but you have a snowballs chance in hell to get payment in 2 months. The court process alone will take a few months before you even get to see a judge.
