The odometer reading statement is binding. The fact that the odometer reading was not correct at delivery is very damning for the dealer and is sufficient grounds to cancel the purchase!

If you drove a friend's car and they didn't have insurance, you'd be covered under your policy.
OH MAN. I feel for you. You have a lot of good advice and looks like you are doing a lot of the right things.
Ask your lawyer if you should cancel the check as everyone has suggested, if that will cause you problems. If not, then get on the phone and cancel it. Get the media involve as suggested.
Make the dealer pick up all the costs. Don't take the truck home. But, be careful, the dealer may tow it to your house. Ask the lawyer what to do in that case.
I hope the hell it works out for you. I'd have been totally pissed then would have pussed out. The smoking in my NEW truck would have sent me off....YUCK. Stick to your guns.

While I truly sympathize, this story does sound too crazy to be true. I wish I could walk in and drop down $35,000 on a new truck. If I found myself in a similiar position my first payment would have never been paid.
an e-mail to the dealer with a link to this thread might be effective pointing out that the dealership has not been mentioned by name...yet. We all know how these threads can get spread and attention from message boards all over the world, anyone remember the one about that guy selling crashed sport bikes on ebay and not disclosing the true condition?

I'd be very cautious about putting any dealer names up here as it could and would be considered slander. Normally might not be worth some ones time to protect themselves till they already have an attorney working the case forementioned. This is a very serious allegation you got going here bud! WOW!

I flip out when i see anyone get close with any sort of object, can't imagine seeing some kid roll in my truck after an all nighter partying! Amazing! That GM deserves to loose his job at the very least. These are not matchbox cars, there real deal big money trucks!

Dealers are in the business of making money. As a consumer you have the right to stand outside their establishment and picket them. I would do that and get some of my friends to also do it. Write a letter to the editor of your local newspaper. Contact the local TV newspeople as well. This is a story for the ages and one that needs to be told to the potential customers in your community. I can't believe ANY dealer would do this. It's like cutting their own throat??

A handfull of roofing nails may 'fall out of my hand' while walking through the dealers lot. Baseball bats and/or BB guns to some windshields are fun too. It won't fix your situation, but it's guaranteed to put a big a$$ smile on your face.

So how many claims have you processed for incidents involving said methods of destruction?
I'd pull the pins out of all the valve stems. Then repeat when they are replaced & inflated.

Wow this is and incredible story. I can't believe that some a$$hole dealership allowed that kind of crap! I would be so pissed that that they would have been calling someone an ambulance along with the police to that dealer.
