it's very simple....

The mileage on the odometer statement is the only mileage you agreed too upon delivery, (with the exception of a mile or so to get your fuel ) otherwise they own that truck NOT YOU and you would like another one..... ( unless of course you'll settle for a REDUCED price on their now used truck that is close to the specs you ordered...) ( including doubling your warranty on the motor and drivetrain.... ) and make sure if you do keep it that you take off the dealers id tag from the back...... unless they want to give you even more off for advertising LOL LOL LOL.... f^%$ them..

Go get 'em DO NOT TAKE NO FOR AN ANSWER HERE !!!!!!!

Firist I feel for you...

I would think It seems the dealer owner has a bit of problem here.

Second see your Lawyer Today! and follow his advice.

I would have the Lawyer contact the owner not the GM and discuss WITH THE OWNER the little probelm we have here... The owner might dicide a lawsuit, loosing his dealer liscinse and all the bad PR wouldn't be worth it and fix things...

However he would have to make things right to your satisfaction (including firing said GM) or I think he would be seeing himself in court.

Next I think my lawyer and I would have a nice sit down chat with the City/District/States attorney to determain just what violations of the criminal code may have been broken and I would pressing charges on any and all violations!

Facts:
1. you paid for it on Friday afternoon.

In many states the transfer of cash is the deal (your lawyer will know) If that is the case in your state

2. dealers son drove truck without owners consent (and the speeding ticket is proof positive of time and place).

Driving without the owners consent, That is also known as Grand Theif Auto, in some states, others it is joy-ridiing .

If this is the case in your state press criminal charges on him and have the little sucker arrested.

Additonally if daddy knew and oked it, that is conspiricy to commit and/or an assessory to a crime, again file a complaint and have them charged and arrested.

Those who knew may also be assessory after the fact (detailer for instance) if they assisted in trying to cover it up the crime. In that case i would file a criminal complaint on them as well.

2. They signed the odometer over to you stating 31 miles but delevered the truck with 347 miles. That I believe is called fruad. Again a chargable offence, again I would file a criminal complaint.

There maybe other consumer law violated as well frankly I would instruct my attorney to rip their ***** off.

Next I would be discussing with my lawyer a Civil suit naming the dealer, GM, GM's Son and Ford motor as defendants.

I would have my attorney contact Ford motor company concerning that matter and to see if Ford would like to be excused from said law suit providing they make things right.

I would likly contact you local version of TV comsumer rip OFF line and tell them as well.

That totally sucks. I can't believe that this kind of thing could even happen. I would drag the owner of the dealership into it as well as Ford corporate. This is not the kind of image that they want related to them. The owner should fire the GM on the spot. I really think that the kid taking a new vehicle to 97 mph alone would make the warranty null and void. Who knows how much damage that caused to the motor. I am sure that the news people will have a field day with this story and you will not end up on the losing end of this deal.

This kind of stuff really pisses me off...

I would think a compantant consumer Law attorney would be pretty much frothing at the mouth over this one.

I have full faith in the american legal system and american Jurys ability to make the Owner of the dealership feel severial times your level of current pain...

I did call my attorney and he got back to me tonight. He told me to calm down, don't worry and we'll sort it out on Monday morning. I knew I should have ordered it from Madden Ford rather than take my X-plan to another 'local' dealer.

I have calmed down since I posted, I still know that somehow I am going to get screwed in this deal. I told the story to my attorney and he asked if he was being Punk'd! Thanks for all the advice, I'm guessing either I'll get a new truck or, preferably, my money back so I can go somewhere else. Otherwise, I may have to get the 'Real Deal' from Hank!

If anyone is looking for a slightly used, Black/Black monochrome Lariat SCREW fully loaded, I think I know where to find one! Low miles even!:santa:

You didn't say if you took it home or not. Please tell me you didn't sign the final paperwork or take the truck home....

The truck is still there, sitting in service I think. I did sign everything for it because they 'are fueling it up.' With the price of gas, I was glad to hear I still got a full tank! It's after I signed everything and looked at every car in the showroom 3 times, and saw my truck whip into the lot the fun began.....

Sorry to hear this..

You did all the right things,, calling lawyer, getting copy of ticket.. I would also call Ford Corp. HQ and Customer Service. Hope they work it out for you..
I would call the local news station also..

It will be interesting to see how it pans out... you signed all the papers, so I would assume that it is legally yours. But with the outragous behavior of the dealer, I hope the lawyer can do something about it. Did the contract show the correct milage or a lower #?

I don't think I would have calmed down.. .I'd be going berzurk and wishing death on the GM...

My sympathies for your nightmarish situation. You have every right to be IRATE.

I would definitely pursue the fraud and maybe the unauthorized use of a motor vehicle complaint. The theft complaint could imply that you had received the vehicle as yours though so be careful and provide as much common sense input to your lawyer as you can. It looks like you have lots of good input here to think on.

Bottom line is this GM got caught with his pants down and jumped right into a defensive posture and hopefully said way to much. I would insist on getting my money back or at least have the resale of a different vehicle transfered to another dealership and refuse to do any business with such an irresponsible and dishonest a$$hole of a dealership. Responsibility should be taken by the GM and owner equally as well.

I do not understand why a person would pay cash for a $35,000+ truck and wait over 5 months for delivery. Makes no sense to me when large dealers have HUNDREDs of F-150's on their lots. What option could possibly be worth waiting 5 months for?

Question

I notice that allot of folks here order their trucks from the factory, why? As someone stated above most of the bigger ford dealers have plenty of inventory to choose from. Actualy I did not even know that a truck/car could be ordered, to the fellow with the problem, I have my fingers crossed that it gets worked out for you.

He ordered it for whatever reason he wanted to. He was spending that much money he wanted it to be just right. I bought mine from the largest dealer in the KC area and still was not just exactly, but I could deal with it that way. I suggest you make notes with dates and times, could prove to be very useful down the road. With all of what you said, makes me jealous you are going to get such a nice truck for such a great deal.

Well not only your Money back from the dealer... You need to be compasated for the lost time, lawyer fees etc. etc.. OR ELSE....

I wouldn't hesatate contacting Ford Corporate explain everything (I would even send a Fex-Ex to Bill Ford himself with copies of the documention including the ticket) and ask him if ford would expidate a duplicate truck (trust me they can) be built, not asking for a freebee, but with your paying ford corp directly a fair price, or having Ford corp help you with a honest dealer to smooth the way so to speak..... telling them how you like fords yada yada yada, but you got so screwed yada yada yada

Corporations can do wonderious things when they are in a really bad spot to shooth raw nerves...

I have seen this in our company...

Understand this, Ford isn't going to want this in the media. News like this is like wild fire (look what it did here) and blows severial hundreds of thousonds in local advertising right down the crapper. I wouln't be ashamed to remind them of this either.
Additionally if ford corp comes to the rescue and fixes you up pronto they can turn it around and look like a hero boot..
