NEED HELP WITH Posble. classact. LAWSUIT!!!
Andrew S. Life is too short, Make it simple for yourself. If you don't like Ford, trade it for a Chevy or Dodge. The hassle you appear to go through is just not worth it. Good luck!

Andrew S, I am NOT up on all the legal points
every one is making here but i have to agree
that if the truck is still considered new
in warrenty it should get a new motor period!
Try selling your truck with 15,000 miles on
it and then telling the buyer by the way it
has a rebuilt engine in it.

All of you guys sound ridiculous at best! Don’t jump on someone who, to put it simply works hard for a living (I assume) and expects what he pays for to be right and at least the product is fixed correctly the first time. Andrew is just sharing info and is after all a fellow brethren F-150 kind a guy. My philosophy: If you don’t like what's going on do something about it! You can be part of the problem or part of the solution, your choice! Peace and love guys. Andrew keep it up. It will only make it better in the long run for all of us if in fact there is a problem and using parts from engines that have failed? Yep, that's a problem!

To those who offered support, thank you. Windancer, yours is perhaps the most meaningful bit of wisdom, the only point I find worth pondering thus far. But to trade it in, I have to actually HAVE the truck in my possession. Which I do not have. It sits, as it has for the past 46 days, in the back of the dealership lot collecting bird turds, leaves, and dry rotting whilst it depreciates. It is a bleak picture, indeed. A tale that perhaps is 20 years too early, I must say, but true nontheless. Thank you whoever it was that made the point about "hardearned money". If I didnt equate losing value in this truck to coming into my house and taking food off my table, I would not be as upset about this issue as I am.
Rock on, guys!!
Rock on, guys!!

Who Is Covered Under The Lemon Law?
Any consumer who buys or leases, and registers a new motor vehicle in the State of Arkansas is covered by the Lemon Law.
The consumer is protected during the term of the manufacturer's warranty for up to two (2) years after the original delivery date of the vehicle OR for the first 24,000 miles, whichever occurs last. If the vehicle is transferred to someone else during this period, that owner or person leasing the vehicle is also covered under the Lemon Law.
IMPORTANT: The Lemon Law does NOT cover the living quarters of mobile homes. The Lemon Law does NOT cover vehicles over 10,000 pounds gross vehicle weight rating. However, motor homes over 10,000 poubds gross vehicle weight rating are covered.
Is Your Vehicle A Lemon?
The law creates what is known in legal terminology as a presumption; the Lemon Law presumes that you are entitled to a refund or replacement if the manufacturer or its dealer has made a certain number of unsuccessful attempts to repair nonconformities that substantially impair the use, value or safety of your vehicle (four or more rpair attempts, or more than 30 days out of service).

exrm,
thanks for the post. Indeed, I do qualify to claim the lemon law, and have requested the refund as specified in arkansas code. The question that remains is: does the dealer still have more time to make the repair after I give notice, even though it has been over 45 days? The last chance to repair only APPEARS to apply in the case of 4 previous attempts, not in the thirty day rule, or so the attorney generals office told me when I talked to them. For now, I wait on my arbitration packet from ford and a reply to my certified mail request for refund. thanks again for replying with the info.

Your pointing out my typographical errors only shows that you can not argue any of the points I have made. And NO I dont care. I have my truck, sue and see if I care. get a life and buy a dodge

Andrew,
I strongly disagree with the class action suit. I am even more disgusted that your truck has been sitting 45+ days.
This by itself explains the problem. I would make this a strong point and insist the dealer give me a loaner truck, get off his can and fix your truck.
I can understand your frustration with the dealer, but not with an engine you don't even have yet. You should have plenty of documentation should a problem ever occur with the "new" engine.

Waldo...thought you were gone (last post in thread??). I guess WWF ended and you had nothing else to do. One of my posts to your last commentary somehow didnt make on the thread, but the gist of it was: If I thought I had ANYTHING to gain by arguing your "points" (which have been so helpful, by the way) I would. Now go watch your WWF videotapes. Confederate states of america??
Jeez, what does THAT indicate? Enlighten me on what that means, and why you identify that in your posts if you would be so kind. I am curious.

I agree less than 36,000 mi. you should get a new motor. A lawsuit may make Ford use new motors. And the ones that disagree must have stock in Ford.

Hi All,
Just thought that I would get in this game. I too would like a new engine with the amount of miles that are on your truck. I am sorry to say but while I worked at a dealership for 6 years, I found out the way these things are handled. Basically, it is up to the service manager if you get a new or rebuilt one. Most people got rebuilt because it was at far less cost than a new one. And the dealership has to eat the added cost. But as I saw, if you were well liked or kissed him, you got what you wanted. Only those who raised enough cain got a new one. It is true that if a rebuilt one is built to specs, it should last a long time. It is also true that these tend not to last the same amount of time. It just depends on who built them and at what time. I don't know about most of you but I had to sign this nice little piece of paper stating that I would not sue or join in a lawsuit against FMC. I tried not to but they would not sell me the truck if I did not. I would have went somewhere else, but I doubt I would have gotten the deal that I got there.

For anyone that cares. That part of the warranty that says ford may use rebuilt or refurbished parts for warranty work gives them every legal right in the world to use rebuilt motors.Regardless of how old or new your truck is when the motor dies. However, if I were in Andrew S 's shoes I would not settle for a rebuilt motor-the dealer caused the damage to his motor and should eat the added cost. Of course, don't our trucks have an engine oil pressure gauge or an idiot light that says check engine oil level-I am not sure exactly what it says. At any rate their is not a lot to argue about, you are granted very specific rights in your warranty.Don't like it buy another brand truck and see if ya like their problems and warranty rights they give you.
Actually I do watch the WWF. It is also one of the companies I own stock in and it is a great venture. As for the confederate states of america....... though we lost the war it did alot for our country, some of the war tactics still used in the south are still used today. So if you are going to stop arguing my pointless points then why dont you just not post any replies to this.
