Exclamation Problem with purchase of L please read!

ok fellas i need your help if you have had any experience similar to mine or can help please chime in. here's how it went down:


i got an X plan pin #. i order the truck, i get the truck. HOWEVER they make the contract out for the A plan price. now no where on there does it say A plan. it just says 28,008. so i say ok. sign. they sign it. done deal. loan is approved sign that. get the extended warranty. sign everything. everyone's happy. i pull out of the lot.

couple days later i get a call. 'Jon we signed the contracts for the A plan not the X plan. you have to come in and resign everything. we need you up here as soon as possible (40 miles away).'

i contact my lawyer. he reviews our documents and says 'they don't have a leg to stand on.' so i call ford back up and i'm like 'hey man i have no need to resign our contract. it's valid and signed by BOTH parties. ' then HE says well is there anything we can do to get you to resign? i say well what can you offer me? he says a free detailing and a few oil changes. i say no thanks, i do my own. (thing was that when i picked up the truck it was dirty so i was pissed but i wasn't about to wait another night to pick it up.) he calls back and says 'ya know you signed a piece of paper saying that you'd abide to the price you are entitled to. by NOT abiding to it it COULD result in the dismissal of the Ford employee who gave you the pin number OR he could lose his A and X plan priviledges, among other penalties." so i was like 'HE can lose his job for YOUR mistake?' and he says w'ell i'll fax you this sheet you can see for yourself. you signed it'. so i said fax it to me and i'll bring it to my attorney immediately. that was the end of our conversation.

if anyone has ever seen this or can help out please do. i really appreciate it. any thoughts are of course welcome. i don't know what can come of this. thank you all in advance!

Ok, here's the deal. X-plans are transferrable. So there is no way the guy who gave it to you can suffer any conciquences.

Now, as far as the mistake goes...

You signed an agreement for a set price, that the dealer also signed. You purchased that truck, agreeing to that price. You are liable for anything that pertains to that price. If the dealer "screwed up", and they want more money, then simply tell them you do not want the truck, and to give you back what you already paid and take the truck back. If the price was legally proven to be incorrect, then your contract is not valid since you did not agree on this "new" price. If they are willing to enforce this new price, you have a right to give them the truck back. NOW, if you were to do that, since the truck has been registered, it is now a USED vehicle, even if it has 1 mile on it. For them to take it back, they have to sell it as used, and will problably lose more money than they are trying to get you to pay.

The big picture is this-- they are to blame for thier own mistake. They are just trying to muscle you into giving in, because they have no legal recourse. You are in control. You have to do nothing. Like I said, if they want to push the legal button, hand them the keys back and see how fast that changes. Feel free to show them my post; I'm a former Ford dealer employee myself.

Sal thank you for the info! i'm going to print this out and i might just use it hehe i'd HATE to give my L back though i just want this all to be settled. tomorrow he is faxing me this magical document that says all the things he threatened me with. i'll keep you posted. thank you so much.

Same thing happened to me. They gave me A-Plan Pricing instead of X plan. The dealer told me about it a day after just to inform me. They didn't ask for me to resign a new contract for a new price. They admitted it was there mistake and profitted from it.

2 things...

if you print this out, make sure there is nothing saying this is f150.com with your screen name in case you mod your truck and have a warrenty problem.....they'll hang you because they are already screwed..

Second. A similar situation arose when traded in my bronco for my explorer. Bronco had a reconstructed title, which they offered me 2k as a trade for, which was way less than i wanted for it and I could have sold it for, but it was agreed upon. The salesman, finance manager and trade evaluator all had their hands on this title and never made an issue of it being reconstructd.....never the less, we signed all the paperwork and I took the keys, they were to send in my rmv1 form that day for certificate of registration and call me to pick up the paperwork. Never called. The next day they called saying that they just realized they gave me more for my trade than they should have and wouln't send in the form untill i agree to pay them the difference-bull**** right....you can immagine how this goes, but between my lawyer and calling ford.....I found out that I couldn't even give them the truck back because I had already signed for it, and that would be registered as a surrender of credit-big black mark on my credit report.....like a repo situation. Needless to say in contacting the owner, he agreed that his people made the mistake and it was their loss and we lived happily ever after.....but definitely find out what your state regulations are as far as giving the truck back after you signed for it...... If I were you, I would keep the truck, and do as I did. When you get your survey from ford on your buying experience......tell them the whole truth and nothing but the truth. I got a free set of explorer sport embroided folding chairs for my grief courtesy of ford (they have new svt lightning ones in the new ford catalog....hint hint). Just bring it to a different dealer for service. Good luck.

now that mistake they made...did they say there was nothing they could legally do? or did they just tell you that today was your day? hehe also, how much was the price difference? i can't believe stuff like this actually happens!!!!!!!!! MORONS!!!!! but hey! i'll take it! later

Some dealers just plain $UCK!! tallimeca my mom got those folding chairs free in the mail when she leased her explorer. Man i was expecting a set with my truck especially since its an SVT. But i got nothing but the bill lol. Oh we got the trucks from 2 differnet dealers so just goes to show you that one dealer that goes that extra mile will be the one to get the repeat business.

Consider this too: The person bugging you is most likely the person that is under the gun for making the mistake in the first place and is either 1-trying to fix it before it is found or 2-doing what his manager told him to do. Either way, go higher.

The next time you talk to this guy, you should ask him to put the owner on the phone. He might not want the owner to know!

If he declines, just call later and ask for the owner, be polite and tell him about the problem. He SHOULD fix it.

Exactly as Sal said...X-plan is transferable, NOT A/Z plan. You purchased with the X-plan and got the A/Z plan price, by THEIR mistake. Do NOTHING. The price difference cant be more than $1000-$1500 dollars anyway.

exactly right..the price difference is $1100 approximately. i'm getting sick and tired of their $h!t already so if he keeps it up tomorrow i'm going to speak to the owner...that's all. thanks for the info guys! later!

You are wasting your time even talking to these idiots. Your attorney already told you that they don't have a case. Just tell them to buzz off and then quit calling them and quit accepting their calls. Then go enjoy your truck.

Hey Dealers really $uck A$$. The salesman is probably ticked off because the mistake is coming out of his commission. Think of it this way...if you made a mistake and payed too much, because of some hidden costs or extras that you didn't catch until after you signed all the paperwork, how far do you think you'd get trying to make the dealer reneg on the contract and give you money back? NOT IN A MILLION YEARS!

Bottom line is its their mistake and since all the papers are signed thatws tough luck for them. Even after that I made them give me $700 for having the front ground effect scratched when they took it off the truck.
