The insurance laws of each state are set by the state legislature. The responsibilities of the insurance companies under uninsured motorists are set by these mandates. While there are federal laws governing insurance co. responsibilities, the states are allowed to require more but not less in their own legislation. This is one factor in the differences in insurance costs from state to state.

I had a 93 Firehawk that was hit by an uninsured motorist who ran a stop sign. He tried to run; but, my car was still driveable. After he realized he wasn't going to out run me, He stopped and decided he was going to kick my @ss. After he decided that wasn't such a good idea either, we called the police. My claims were filed under uninsured motorist and the insurance co. went after the other guy for their money. I didn't have to worry about anything but getting my car fixed, finding someone to buy it, and buying another.
