The fact that an officer makes a simple clerical mistake does not prove or disprove guilt, and typically will have no bearing on the case. Where it can be used is to show that the officer is capable of mistakes, and hence perhaps erred in his assessment of a violation. I have used this very tack to get out of a ticket myself (by "get out" I mean be found not guilty as opposed to a dismissal due to an error).

DO NOT TELL THE prosecutor!! I had a ticket where they made a mistake, I went in and told the guy, and he turned around and asked the judge if he could change the case, it was granted, and it was changed to my real info. Your only chance is to wait until the guy rests his case, and then say this is ticket is not for you, since the DL # is not yours. I am not a lawyer, but this did work a friend of mine, after I told him about my story.

Wait till court. Plead not guilty. Show ticket to judge, show drivers license. Explain its not you. Automatic dismissal in Texas. Want to be safe, take an attorney.

Question Wrong DL # on Ticket

My brother got a ticket the other day, but the cop put the wrong driver's license number on it. I figure he can get it dismissed because of this, but I'm not sure. Any of y'all know?

Duck,
This may sound pretty bad but I have never gotten a ticket (knock on wood)! Been pulled over about 6 times but got out of all of them, including a 75 in a 30....I thought I was going to jail!!
