What can I do? Help!

I went to Walker Ford(727-507-8513) and bought a 2002 Black S/C HD on December 18, 2001. I put a $1,000 deposit on the vehicle which had been ordered on Novemeber 27, 2001.

Early January I called Ford to get information on my Build Date and they told me the dealer should have given me all the information about my truck, such as an order number they could used to find it's build information. All I had received was a receipt for my $1,000, they had put all my paperwork in a file(which I saw, it had an order date of 11/27/2001.

To make a long story short. I went to my Dealer on January 13, 2002 to get my info and they told me that Mr. Walker wanted my truck and that they had to order me a new one. So my build date has been pushed back considerably. I won't be getting the truck I bought, nor will I get it by the end of February as promised.

I told them it wasn't right but they insist that the owner is going to get my truck. Isn't a deposit a contract! If you agree that this is wrong will you support me and call Ken Osbourne (727-507-8513) and politely tell him the Lightning community shares my concern.

i would get my deposit back and cancel the order, since you have to wait longer anyway you may as while take your money else where and deal with another ford dealership. Unless the $1000 is non-refundable. my thoughts

report the dealer to Ford Service, that's not something a dealer should ever do.

I received a call from Bill Hudz(sp?) today at Walker Ford. Frank Walker wanted to know where I posted so they could read what I wrote. He should be showing up shortly. Give him a big thumbs up for me. :-)

Hope it doesnt turn out like that Volkswagon ~or was it audi~ guy who got SUED by a dealership for posting about their wrongdoings on the internet.

He ended up winning that case, I have followed and read every single post. I have not slandered the dealer only told the facts. I also have three lawyers on my street and I have talked to two of them. Their taking over the world and I only talked to them to make sure I don't incriminate myself. BTW, it wasn't the dealership, it was the manager, Mr. Farmer that sued for slander and in doing so got himself into a heap of trouble with the dealership.

Yup..that was hilarious.

Absolutely the biggest bonehead move ive ever seen from a dealership.

Sounds like Walker is doing something another dealer tried here. We gave them a deposit when we came back from Sturgis in 2000 after seeing the SCrew. Dealer hemmed and hawed about a final price for months, then found out 2 others came in and went to dealer employees, and when one came in for us, it didn't have the options we wanted, plus they tried to say it was MSRP or nothing. THEN, the salesman started to yell at me about not trusting him (I sold used cars, I don't trust salesmen) so I took my deposit and called the competitor across town, a small family dealer. Got the truck at less than 1% over invoice, WITH add-ons such as spray in bedliner, tonneau cover, truck cover, and wind deflector, all HD logo'ed.

Found a dinged wheel a month later, looked like from the tire being mounted, and the dealer replaced it, no questions asked. It was obvious that the damage was not from hitting a curb.

If you are near Southeast Virginia, I highly recommend Bowditch Ford, Newport News, VA. They restored my faith in dealerships!

Back to the subject of this post, Walker is acting just like a baby in stealing a truck from a customer. And thats what he is doing in my opinion. I had a dealer steal someting from me after buying three trucks from them. When I purchased my 2001 Ford Ranger the manufacture FORD was offering free bed liner and a free bug shield. Well the bed liner was already installed in the truck and went to get bug shield when the Parts Manager said that the bug shield was already billed out in the computer. That means the bug shield ended up on another vehicle. So to this day I dont have a bug shield, by the way Ford paid the dealer for the bed liner and the bug shield cause I check with the accounting office and sure enough Ford paid the deal.
Any way I called Ford and some company that they contract to tell me that Ford does not get involved in the sales end of the deal.
So I slammed the dealer on a survey and some other company that FOrd contracts with called me and said the same thing Ford does not get involved in the Deal.
SO in the end after buying 8 brand new vehicles from Ford I am no longer going to buy a ford product
Matter of fact I am waiting for the new 2003 Nissan 350Z thats coming out this year. 0-60 in under 6 seconds and less then $30k
Its going to be a Mustang killer and if not I will make it so.
may even be better then a lightning.
I will be keeping the HD F150 cause there is no way any other vehicle is going to keep the value that this truck has.
Except a Z06 Corvette!!!!!!!

By the seller (the dealer) backing out of the agreed upon original deal of suppling the Buyer (YOU) with the the product to have been purchased (the Truck) he has just violated the contract "if it was not stated in the contract that he is capable of changing terms". This means that unless he made it clear in the contract ,that I imagine was in writing, that he can change delivery date and not be held accountable for violating the contract, He is guilty of screwing you. It is also a violation of contractual laws to knowingly sell, trade, or deliver the product of the contract to a third party after a contract has been formed without the buyers approval. By the third party (Mr. Walker) receiving the truck that was originally to have been yours the dealership did it to you again. There are many different approaches that I can come at on this subject. Oh yes I know more ways that you can get em. BUT (big but) Did you read the fine print? Do you have a copy of the contract? Proof of deposit? I need more info in order to start pointing fingers. REMEMBER the one major point to all contracts is that the seller (unless death occurs or it is stated in the contract or it is illegal) can not back out of the contract. there are clauses to this but i aint got all night. OHH YEAH, Im studying Business Law. Its a hobby and a prereq. to get in to the UF school of Architecture and Building Construction. Best part is my work pays for it. I LOVE IT. I seem to remember the same thing happening to one of the guys on here who had ordered a 2000. Long time ago though. Don't remember who it was.
