more speeding ticket questions

I got the information regarding my 91mph in a 65 speeding ticket. The bill is $300, not including traffic school. The ticket also says as long as the speed was less than 99mph, you are eligible for traffic school.

My question is, the slip I got in the mail does not have my correct licence plate number (a 'D' instead of 'O') do you think I can use this to my advantage? All my driver's licence info is correct, just my tags are wrong.

Nope...won't make a bit of difference. The truck did not get the ticket. You did. If your DL info, date, time, location, etc. is all correct, that is all that matters. What vehicle you are in does NOT.

Actually Fepony, if anything is incorrect on the physical ticket then you can appeal it and it will get thrown out 99% of the time. I had a ticket thrown away because the officer spelled my address wrong on the ticket. The best one was I had a ticket thrown out for 60mph in a school zone because the officer never checked the box saying how he estimated the speed, radar or estimate. I thought I was just going to get the speed i was going reduced to 45 which is much better than 60 but the judge threw the whole thing out.


So it doesn't hurt fighting them, it is not like they will make you pay more if you lose.

another problem is the court I would have to go to get it resolved is 340 miles away (one way).

I want to go down there and say "This is not my vehicle, I was in my vehicle at that time, and I have witnessess"

I guess I am afraid to travel down there and not get any real payback.

The cop has no reason to lie. I would bet that they would not throw it out on account of a licence plate mistake - especially an O/D as opposed to say a "1" and a "Z." Unles the judge is extremly jolly, he will look past that and waste your 700 miles.

You may not have to travel the 300+ miles to fight your ticket, I once fought a ticket by writing a letter to the court (it was about 80 miles away for me) the court was able to tell me the proper way to go about it. The only downside at the time was that if you contested a ticket you were not eligible for traffic school so it went on your record if you lost, I was not eligible for traffic school at the time so I figured it was worth a try...I still lost and had to pay, but it made me feel better that I at least tried. Contest the ticket, and if you lose and have to pay, write a check for the fine plus a few bucks over. Fine is $300...write it for $307 or something like that, they will catch this and send you a refund check...but dont cash it! I heard it dont go on your record until they get the paperwork right. dont know if this works or not, Ive never tried it personally, might be worth a shot?

That is what I was told. That's all I really know. I can however tell you a true story that might help. I did get out of a speeding ticket 90 in a 55 with some creative lying once. As I pulled up to the courthouse to go to court, I saw the "officer" sitting in his cruiser reading the paper in the "officers only" parking spot out front. When we got into court, the officer told the judge that he was using radar when I was caught. I told the judge that as I approached the "radar trap" that a "red corvette" blew past me on the right hand side. I looked over and saw the officer in the cruiser reading a paper. He then pulled out and chased ME down. He never even saw the corvette because he was too busy reading the paper. He then told the judge that he NEVER reads the paper while on duty. I then told the judge that if they go out and look in his cruiser he probably has a paper in there at this very moment. You should have seen his face. The judge asked him again and he said yes, I do "at times" read the paper. The judge threw it out and verbally reprimanded the cop in the courtroom! He was soooo p*ssed! Good luck...btw feel free to use that if you want...it worked once.

I just got a ticket two weeks ago for doing 81 in a 55 zone and it's a "double fine zone". No, I'm not elegible for traffic school, so don't know what to expect.
