Angry Mustang Hit Me In Rear Allstate Trouble

3 WEEKS ago a 1996 mustang cobra hit he in the rear of my extended cab 1997 truck.

damage to him-- i would say a total loss- both air bags went off and total front end damage hood bent in half car ended up under my truck. he was not hurt. in the police report he was 100% at falt but not given a ticket.

my damage-- bumper dented up a little
both brake light broke oout some
a few dents on passanger side back end
a few scratches on drivers side quaterpannel
spare tire flat
rear axle has a leak i never saw before
rear end is shaking weard
tailgate dents and the lock don't work
MY 2 KIDs WERE WITH ME AND EVERYONE WAS OK

HERE IS THE PROBLEM!!!!!!!!!!!!
THE MUSTANG GUYS INSURANCE CAME OUT AND SAID I HAD PREVIOUS DAMAGE AND WERE only going to give me 300.00 for the damage. i had no damage except for the door cracks. which is not included in the claim
my local body shop said atleaset 2700.00 damage
my insurance company is 100% behind me up to this point and now aLLSTATE IS HAVING A SPECIAL INVESTIGATORN LOOK INTO IT.

ALLSTATE HAS PAID FOR A RENTAL CAR all this time a sunfire yuk!

what is everyones advice on this!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

my insurance company has said we could go threw them but loose the 500.00 deductible i have.

i have nothing to fear from this allstate crap but you never know what they could pull next ( insurance fraud)

i had new jersey inspection on the truck a few days before the accident , a plus for me since i would not have passed inspection with the damage

Yeah, insurance companies suck, 3 weeks ago i hit a wild turkey with my Dodge, went right through the windshield at 70 mph, luckily it was on the passenger side because there was glass and feathers flying everywhere. When i got to work i called my insurance co. Since it was saturday i got transferred to the national claims center. There computer said i had a $500 deductable on glass even though i had full coverage. They then told me to pay for it out of pocket and call my local agent on monday. So i had a local company i work with all the time replace it at cost. The insurance company straightened out my policy but i haven't been able to get a reinbursement. My insurance agent says to call the national people and file a claim, the national people say i can't file a claim, i need to talk to my local agent. So no money so far, luckily i got it done cheap because i don't know if i'll see anything.

who ever thought of insurance is a smart person....but on that note why do the insurance companys give you so much chit with all the money you pay a month or six months or once a year and they dont want to give you anything.....The deductable stuff is a bunch of crap.....

No offense to anyone who has Allstate insurance......but those guys suck. A guy hit me once who had Allstate and my insurance agent just rolled his eyes when he found out. Supposedly they're a laughing joke in the insurance business.

I don't know how they can say that you had previous damage without any type of proof. Thats weird. If you file a lawsuit, that may make then change their minds.

Allstate is the pits. Friendly people who offer you nothing... it is not the fault of the grunts in the front line, it is company policy. I have been fighting/working with Allstate for 10 months now after one of their insured crossed the centerline and struck me... and he had insufficient insurance to boot.

By comparison, Geico insured my truck and paid off very liberally without a sqeak even though this clown should have paid for it. Dairyland were angels... paid my bike off and my accessories without complaint and minimal paperwork.

The people I have worked with at Allstate are OK... it just seems that their hands are tied to make a reasonable deal.

When I got hit from hit behind, I paid my $500 deductable and my insurance company paid the rest of the damage. They then went after the other guys company, allstate I believe, and within a few weeks I had a check $500. They got his insurance to cover everything.

mightyfur - insurance in NJ sucks, go after them.

Ford4ever - if it was just a windshield why even bother going through Insurance companies to get it fixed? If that was in NJ it would have given them an excuse to jack up premiums even more.

Allstate may be in trouble

Despite desperate attempts to keep this out of the press, Allstate is currently under federal investigation for illegal business practices, not the least of which is their claims policies. For years they've kept profits up and costs down by sticking it to people who make claims against them, both customers and non-customers alike. Undervalued damage estimates and overvalued deppreciation levels have been their mainstay and company policy letters say so. Now, we all know all insurance companies do this stuff but Allstate has made a killing taking it to extremes. My father-in-law is a loss control specialist for an agency that insures mostly commercial vehicles and they don't even deal with Allstate. They take them straight to court because it's the only way to get them to pay. Look for headlines about Allstate's legal issues to start surfacing in the near future with some hefty pay offs and compesation to customers to follow.
