The man is guilty. This story has literally been dredged and re-dredged here in Georgia over the years. His gun casings have been linked to another shooting. And eyewitnesses placed him as the shooter. Almost every time someone is up for execution in Georgia, the liberal Atlanta media questions things that have even been proven in a court of law. Then when the national media hears, it becomes a circus event with some international media involved.
There should always be a price for snuffing out another human being's life, plain and simple. And that price is the death penalty.

From what I've read about it, some witnesses have recanted thier testimony placing him at the scene. But there were quite a few others that have said he's the man. The guy may have been so high on crack that he really thinks he did not do this. Considering the over whelming evidence, I'd say he needs to go.
In Texas, we probably kill twice as many criminals than any other state. It usually takes between a quick 10 years to do the deed to almost 20 years to put the creep down. There are endless appeals and a host of folks looking at all the T's to make sure they have been crossed and all i's dotted. But I think maybe we need to re-examine the critieria for what is the ultimate price. I think there needs to be a certain amount of unfamiliar witnesses and depending on the crime, DNA evidence to put the perp down. As of now, all that has to happen is the DA request the execution considered in jury deliberations.
While probably not pertinent to this thread, one of my running buds in on the Texas Pardon/Paroles Board. He's been in the business all of his life and like me he's close to Social Security. A few years back he was telling me about a man that was within his final days on death row when DNA evidence cleared him of all charges. He was let out to his family and had filed a suit against Texas for wrong imprisonment which he would have won, just how much the jury would decide. Within a week of being released, they found him in an elderly couples house eating chips and watching TV. He had broken the front door down, beat the old man and lady with a hammer killing them. He's now back on Death Row. Sometimes justice is hard to come by for all the folks concerned.

while i can understand waiting a couple years for an execution (so truly innocent people have a chance to appeal), 10-20 years is ridiculous.
Yes, it's a pretty hefty penalty to pay for commiting such crimes.
I'm more against the penalty of death that the victims of such crimes pay than I am the people paying this penalty as a consequence of their murderous actions. Not to mention the penalty of living with the loss of a loved one that the family and friends of the victims of such crimes must suffer.
Death is a harsh penalty, but I believe that there are some crimes that life in prison is not an appropriate penalty for. Some crimes warrant a harsher penalty.

We had a guy here in Mississippi in his mid 20s that killed one of his crackhead buddies for narcing on his brother. Killed the guy with the claw end of a framing hammer. At sentencing the judge asked him if had anything to say before he was going to be sentenced. Judge was going to sentence him to life.
He told the judge if your going to sentence me to life you may as well just give me the death penalty. The judge replied I can make that happen and gave him the death penalty. Of course the guy changed his mind sitting on death row. The judge did make it happen after 10 years of appeals.

I dont see why a guy would want to sit in a cage for the rest of his life. If it were me and that was the choice I'd gladly take the death penalty. Cant even begin to understand why they drag it out. That might be part of the reason I'm not really for the death punishment..

the officers family has had life on hold since 1989, in the mean time then death penalty case has attracked several people that are paying for the defense.
had he recieved a life sentence, no chance of parole. society does not have to worry about this guy(this is and should be the #1 concern of everyone), celebrities arent involved paying for the bill and best of all the officers family can start putting life back together the best they can and not be concern with the convicted guy anymore.
i don't think anyone know what they will do in the face of death. never underestimate the will to live.

34 witnesses saw Mr. Davis shoot Officer MacPhail. Three of which were U.S. Airmen sitting in the Burger King drive thru. The jury was composed of 7 blacks, 5 whites.
Why should taxpayers be forced to pay 40-55K per year to keep this guy alive? Not to mention, this isn't the only crime he was guilty of.
