may pass a new law in Texas that first time offenders will get differed adjudication, only after they are put on probation and dont screw up again within a year.

aaaaaand GO!

EDIT: forgot to add, MADD (mothers against drunk driving) are behind this..i believe i heard somewhere that there are over 100,000 (court dates i guess) put on hold in Tejas

That's very un-Texas-like! I would not expect that from them at all.

Sounds like thinning the herd to me.

Average inmate (in NC) cost the state around $33k a year. Thats alot of money for 3 hots and a cot.

As they state in the video link, a second DUI will still be treated as a second DUI.

We all learn the hard way about something/once in a while. I no way condone drinking and driving, obviously, but most times a second chance would promote not to repeat the offense, which I feel is less likely when you're hung up to dry. Although a stiffer penalty should detere people from making the mistake in the first place...

There's been the odd time I've been pulled over for being 5-10kms over the limit or what not, I am always much more willing to make sure to obey the rules when the officer is kind, gives me a warning and a chance at redemption rather then abraisive and slams me with a ticket. It's obviously not so, but getting hit with a ticket sometimes gives you the feeling you might as well break the rules because you paid for it.

Deferred adjudication or not, it should still include a license revocation.

Personally I think that the laws are way to slack in Mi. U can get a a DUI and still keep yr licence as long as u are not driving between certain hours. Some argue that they will loose there job etc.......Well IMHO thats tough ****, if you drink & drive and get caught u get whats coming to ya. I think for the first time a 5yr ban (on any sort of driving) the second offence it should be for life. They need to include the whole country so u cannot just go to another state to live & drive! Its not taken seriously enough. That being said I think that the open container law is dumb, if the driver is not either drinking or drunk I see no reason why others in the vehicle cannot drink.
