Yep, same for myself. I go through one about every 6 months or so, its not that often.

Hi! Thanks for your responce, I don't plan drive & drink I only want to know how in a more advanced society manage the DWI problem.

Here in Mexico the citizens say is anticonstututional because nobody can be molested in the transit unless you are suprised doing something wrong. it's something like a free transit law

Do you have a similar law there? about don;t be disturbed my LEO if he don't saw violating the law or have a warrant?

Every HWY patrol can stop you only for check if you have alcohol breath while driving?

Thanks for your input. Here in Monterrey N.L. the legal limit is 0.40

How many beers needs to increase to 0.40 the alcohol level in a 200 lbs male?

In short, no. Probable cause (not suspicion) is needed to conduct a traffic stop. Prosecutors cannot obtain a conviction if the initial arrest was made without probable cause.

That is why they do the checkpoints. They are not stopping cars at random. They stop EVERY car traveling a particlar road during certain hours. Around Charlotte (Not sure if it is city or North Carolina) I have seen where they have a bus to complete booking, and it has a mobile court room so you can be booked and have your hearing in a couple of hours.

And don't worry about the US being "more advanced" then Mexico. Barack Obama is dropping our standards FAST.

are you sure its .40 and not .04?

You would have to slam at least a dozen beer within a half hour to come close to .4. On average for a social drinker you are unconscious at .4 and dead at .5.

I just read it 0.40 mg/ml maybe you have different units of measure.

In VA they have sobriety checkpoints, that is even what it says on the sign going up to one. They will have tons of officers waiting, one or two per vehicle and they will check your vehicle and for someone apparently drinking. I have been through some before that just said hello and didn't even ask for a license, just if you had been drinking. About once a month, although it happens more in the summer (for obvious reasons). I don't drink and drive, so it's no bother to me, as long as they leave me alone about my vehicles. Straight pipes are legal in Tennessee, but not in Virginia, so if you cross the line they get all gung-ho about pulling you over, on the interstate at 3a.m. like you were disturbing someone. I have also seen VA/TN police work together at the state line and have a HUGE roadcheck, they also did it at every fairly close entrance to the state at the same time to make sure nobody got in or out of the state via that route without getting checked. I think they should have them every night, to be honest.

Happens quite often here as well (MA). Officers just stop every vehicle and ask what you've been doing and if you were drinking.

They're very strategic with it around here, too. They place all the stops at major intersecting roads to stop as many people as possible, from about 10pm until 4am. I'm all for it... way to many people drive after they've had to much.

I've been stopped before and was honest about having 2-3 beers before heading home. Cop said alright, take it easy. Their really not looking for the answer you give, but more about what your eyes/reactions/ect. are doing while your explaining where you've been.

something funny i did last year. Got home from work friday night at 1. my old lady went for girls night out and i just went home got cleaned up and was watching south park. get a call from the old lady to pick her up because she was pissed drunk. Go pick her up and on the way home got stopped at a stop check. Me being a smart guy decided to rub my eyes real hard before the officer came to window roll it down. officer says hello, I say He.... (give one those hiccups like you are trying to hold your alcohol down and not puke) then a real fast hello. Officer looks at me, "come with me sir." kind of a stumbling staggered walk over to the cop car get in sit down. asks me "have you been drinking tonight sir?" me, "nope." Blow into this please he says, I do, 0.00. He looks at it with a puzzled look on his face. tells me to do it again, I do, 0.00. We did that about 4 times, he gets me to step out and walk down the line for the parking stall, I walk it perfect 3 times for him and he says "you haven't been drinking, have you?" I replied "nope." My old lady is killing herself laughing. He wasn't so amused. Tells me to get back into the car, I do. Sits me in his car and leaves me their for about 45 mins (my fun was long over by then) comes back and gives me a lecture about how he could have taken me back to the station for another breathalyzer, and blood tests, and could hold me for 24 hours just cause. He let me go but it was hilarious while it lasted.

Actually... I dunno why I didn't think of this yesterday... but a friend told a cop at a checkpoint that he was drinking like all night and was drunk. Till they did a breathalizer and they found out he was screwing with them. They told him to go home and quit messing around as this was serious business.

Can they really do anything if you pretended to be drunk?

I don't think there are any laws in place stating that if you feel its funny to screw with cops at DWI check points by being pretending to be drunk that they can do anything. I've heard of truck drivers doing that crap.
