he gets out stumbling and yelling obviously was drunk. the first on the scene was his son and dep for the fire dept. so short of the story i got screwed by the buddy system. i was in the wrong for not yielding right of way but its difficult to do so when the vehicle that hit you was going 15mph over.

Yes, you would be at fault for that accident. If the guy was D.U.I., then you should have called the police and made sure he was hooked. The "buddy system" is one thing, but when it comes to a D.U.I. traffic collision, it is kings x. Even if he is not at fault, he can still be arrested.
