To make along story short our house was flooded on Aug. 18th. Our finished lower level had 8 ft. of water in it. So we need all new mechanicals for the house. Every thing went smooth except for the hvac guys.They started 9-11-07,and still are not done. I paid half down at the start with the rest to be paid at completion.
On 9-10-07 we had our twin daughters born.They have been in neonatal I.C.U. since then. They might get to come home in a week. We need the house climate controlled.
So my question is can I terminate these guys and hire someone else? They have not even worked a full day on it. Sorry this was so long.

 

Looks to me like you're free to fire them. All they can do is try to sue you, which they will lose for non-rendering of services.

 

Who is your hvac contractors name. I'd call the estimator ( if you delt with one, larger contractors usually do). Start with him/her. maybe he doesn't know the workers aren't showing up for work.

 

I am dealing with the owner. I am going to write a letter stating they have one week to finish. If not they can have the half down as payment for the services rendered already,and I will find another contractor to finish.

 

did they do half the work already? otherwise tell them your getting a laywer for scamming you. sounds like the contractors in St Peter when the tornatoes rolled through. I think alot of people got scammed in that storm.

 

Yes they have done at least half the work.It started good but then the owners son was pulled off job and left a part time hvac installer full time college student who seems to be in over his head to do the job. It went down hill fast. We are fed up. You would think they would want to finish and get the last $5000.00.
