I understand the point of your argument. My problem is if they were truly taking McDonalds to court to stop the brewing of coffee at such a high delivery temperature, then they should have kept enough of the settlement to pay their court costs, and donated the remainder to a National Burn Center. It was not as altruistic as it appears. Remove the promise of money from the equation and the lawsuit goes away. Therefore, I believe this person should not receive money for stupidity if it could have been prevented with a reasonable amount of caution on their part. (ie. put a lid on the coffee, put the coffee in a container made for hot stuff, sip the coffee down to a safer level prior to operating a motor vehicle, and by all means, let someone with a reaction time quicker that molasses flowing uphill handle the drink.)
FYI- McDonald's doesn't brew their coffee at a temperature any higher than people do at home. They place it on a heating element to keep it hot after it's has been brewed. The heating element is what makes the coffee so doggone hot. They do this to make it keep longer, not to make it taste better. The coffee is undrinkable, straight from the pot to a cup, after about 5-10 minutes. Most people don't try to drink it until it has cooled some. Everybody who has been severely burned by this coffee, whether they were responsible for the spill or not, was burned to save McDonald's a crapload of money on thrown away, old coffee.
Man. McDonalds DON'T throw away ANYTHING anymore. They keep their fries FOREVER or at least through 10 times of re-warming them up in the OLD oil they use.

Oh, you wonder why RockPick can afford a nice new house, nice truck etc, well I'll let you in on a secret. RockPick sold back all his 10 - 15 year old ketchup and mustard packs (them little things) back to McDonalds and they have been using those for a while.

I would be willing to bet that there is a 40% split lawyer in that mix as well. I'd also bet they received plenty of "counseling" by the lawyer to arrive at the dollar amounts they asked for as well...

Since were on the subject of coffee ...
am I the only one finds these coffee yuppies hilarious when the get their coffee in a normal or styrofoam cup and then need another wrapping or napkins because it's 'to hot to hold'.

I get a coffee from the Tim Horton's drive-thru 2 or 3 times a day.

I always ask them to "double cup" it, because it is so freaking hot, even with 2 cups, it's sometimes difficult to hold onto.
With that being said, I've never spilled any on myself, or injured myself. I know how hot it is, and if I do blunder and drop it in my lap, well whose fault is it?

I can't count how many times I've seen people order coffee at the mall, take a sip right away and then back away because they burned the tip of their tongue. It's like they can't understand the concept of hot.
Anyway, my motto is if I can hold the cup then it's fine to drink. Maybe hot cups don't bother me as much as other people
