I think your best bet is to re-read osbornk's post and follow it to a "T".
Documentation is your best defense, verbally demanding will get you nowhere.
I was unsuccessful when my truck received 12K in repair which included a new frame, I wanted it totalled but my insurance (AAA) would not even consider it.
Fortuneatly since the repair (last December) i can't tell the difference as far as road quality from the before and after. I did consider trading it in just because of the "stigma" of having a repaired truck. But decided not to go
2 grand upside down to get into a new one. (bought mine Jan. 04) and as you know Ford is pratically giving them away now.

diminished value.

So...can you get diminished value compensation on a vehicle that is wrecked, but not totaled? (Say 1000 in damages)

From what I was told when my mustang was totaled you can only get diminished value when the car has not been totaled

It may vary from state to state, but in NC when I had my accident that was the way I understood it too. It might be a good bet to check with your state's dept of insurance. But I think he's trying to convince the insurance company to total his vehicle instead of paying a diminished value claim on top of repairs. I do know if he wasn't "at fault" he stands a better chance of getting his wishes. As others have said... don't be a jerk but do be agreeable but PERSISTANT.

I don't know about that, Blitz. I was ready to buy a '95 Bronco last year until I read the CarFax on it. It was not salvaged, but the report read that it was involved in a "frontal collision" back in 1994. Carfax states that it can get information from police reports on collisions. BUT...they don't guarantee that every vehicle's crash history will be in their database. It also depends on which state the vehicle was crashed in.

Anyways, sorry to all you guys who've gotten a crappy deal out of being wrecked.

I feel for ya, man. But of course, I got my truck as a result of the accident, so it may be the best thing to ever happen to you!

Thanks for all the advice. I am still waiting for the official damage report from the body shop. I am at $11955 right now and was told the official estimate will be higher.
