I didn't want to post this in the other thread cause it's pretty full as it is, and this is kinda a different issue.
I've been reading about that issue with the 5.4 Ick. Seems weird to me, when the second time a bro of mine took his 150XL XCab in for a leaky headgasket, they sent him home with the truck as is... till the NEW (brand new motor) came in. 5yr warranty no less.
I'd put my foot in FORD's @55 over this. They can't afford another PR nightmare right now. If they were threatened with one, they'd capitulate. Your state laws may vary... bur remember that most places they're only REQUIRED to give you an engine thats functional, safe, reliable, and carries at least warranty enough to meet the end of the warranty period of the orriginal power plant.
There's no law that says major components have to be replaced with brand-new parts. I know this from an accident I was in. Lady rear-ended me and then sued me (she lost). She wanted (or her hubby did) a brand new engine. I let my ins co fight it out, but they told her to **** off about a new motor. Its a different issue, but the law applies in either case.
Bottom line? If you had a motor with over 2 years of warranty and more than 24K miles left in the warranty, then you're entitled to more, and if that means a new engine, well... thats up to Ford.
IMO, they oughtta replace with new. Not that they HAVE to, but they just SHOULD. If they did, don't you think that person would be more apt to buy Ford again?
