Any one ever get rear ended towing? I did.

Any one ever get rear ended towing? I did.

On sunday I am on my way to go pick up some furniture with my hulmark enclosed 7x12 trailer and I am stoped at a red light and this girl rear end's me hard. My trailer is gone and my truck is screwed up the trailer hitch is pushed in 6in and the bumber is bent up and in and the tailgate wont open. any way I had the trailed towed on a flatbed and the truck is driveable but it pulls to the left I looked under and all I see that is bent is the trailer hitch and bumper mounts. any one ever have this hapen to them? is my frame bent?
My insurence came out here this morning and they said there is $1900 damage to my truck plus the trailer that is a 2006 and costed me $3500 otd. Plus towing and a rental car. any way i call the other guys insurence and they say they only cover up to $5000 damade I dont know what to do I am going to fight it. So far they tell me if I go rent a car I am on my own and they wont pay for it because it will go over the $5000 mark. this is BS what can I do to get them to pay me in full?
and if i go thru my insurence they want $1000 deductable and they wont pay for a rental becuse I dont have it on my policy and they wont pay for the trailer becuse it is not on my policy.
I willl try to get some pics of the damage tomorow.
Insurence is a big scam they take from me $140 a month and then when u nead it they find a way to screw you. and this accident is clearly not my fault it says it all clearly on the police report.

Unfortunately, if the hitch has been pushed in any direction, your frame is probably bent. The hitch is mounted to the frame. Since it is pulling to the left, then more than likely the rear axle has bee shifted a bit.

Sorry to sound harsh, but you are underinsured.

Too bad you don't have uninsured/underinsured motorist coverage along with towing and rental coverage.

The only way you are going to collect in full from the other motorist is take them to court and by the time you get done, the lawyer's fees will probably exceed the deductible on your own policy. They are underinsured too but $5000 property damage probably complies with your state minimums.

Check your homeowner's policy, your trailer may be covered under that.

If your insurance agent is worth a crap, he/she should be able to advise you as to the best way to proceed from here.

X2-people laugh at me because I pay almost $2000 a year on insurance just for my truck/van. Well when i wrecked my ranger last year it cost me nothing and I walked away with more money than what i paid for it and got a brand new F150 (plus some chick got new to her car coutesy of me). Insurance isnt something to mess around with. If you have a good company/agent he should be able to take care of this. All else fails if it is clearly the other persons fault lawyer up, and if you win the case the other person has to pay all fees anyways

frame is bent in several places between the cab and the front of the hitch. the hitch is 2x stronger then the frame, so it will bend the frame first. Did the bed shift forward any?

can you post some pics (I know it will be heart breaking for you)

A good body shop will measure the frame when they do your estimate and if they don't do it on thier own, ask them to do it just to be sure that your frame is still straight. Also the impact could have simply knocked your allignment out

David, that chick's insurance company is responsible for ALL of the damages. Take her *** to court. And don't forget, your neck now hurts. LOL

Nope I have not been rear ended, but is is a miracle.
People are stupid, and people are bum holes. It is like they just freak, when behind a trailer. They do stupid sh!#. I have to tow my travel trailer through city streets every time I go camping. I have heard the screeching of tires behind me more than once. I am a very carful driver. With my trailer I slow down way ahead of lights. I signal way ahead of turns.
People are just a$$ho!es. And stupid to boot.
I have good insurance, and a damn good lawyer. I know I aint doing nothing wrong. So if some idiot hits my trailer, I might just own his house when I am done!

man I hate to break it to you, but if your hitch moved at all, your frame is jacked. Sounds like you might be getting a new 150 out of this. And you should definately fight it. They have to cover all of the damages and it would be a landslide victory in court

Sounds odd that your trailer is not covered while attached to your vehicle. I tow my travel trailer a lot and have checked into this. While my TT has its own insurance its also covered by the car insurance while attached to the truck regardless. The catch is should the trailer come unhooked from the ball and strike another object then its not covered by the car insurance.

I would check into that, besides the fact that it was the other persons fault it should be covered.

Trailer Insurance

I bought a small Pace trailer several years ago. I decided to insure it. My truck insurance covers the liability on it, but I had to buy theft and colision insurance on it seperately. My agent asked me the value of it. I told him the full retail cost of a new trailer $2,600. He wrote me a replacement value policy, with a $2,600 max for about $20 for 6 months. He says that if someting happens to the trailer, just to replace it and they will pay what ever it costs, up to $2,600. I call that insurance too cheap to be without.

Also, if you owe a lot on your truck, you might want to get gap insurance to pay the difference between what you owe and the low value that the adjuster will try to tell you that your truck is worth.

That doesnt sound right...

Davidmiz, I cannot say for sure on New Jersey state law, but i know here in VA thier is no cap put on repair cost and also a rental has to be provided during the time inwhich your vehicle is not able to be driven (ie. from damages or while in shop). If the girls insurence company does not readily coperate I sugest you contact the New Jersy Beruoe of Insurence to file a complaint, and also recontact the insurence company and inform them you are making the complaint. I hope this information is helpful to you and everything works out for the best. Also do not hesitate to have a differnt shop provide a repair cost quote. Have a good day. Robbie
