BfB--

nope, it's not illegal for a cop to mark you down. when i give my tickets, i make very detailed notes on the back of the ticket in the space provided. i include how i arrived at the real speed i clocked the guy on the radar or by a rtd formula or whatever. i include the weather, traffic, unusual events (construction, damaged signs, street markings, sun in the driver's eyes) and anything else that might be related to the event in question. and although i may have caught you doing 85 in a 65, i will generally write you a ticket for 9 over or something similar for a couple of reasons:

1) it's a favor to you because speeding is not the worst offense in the world, so why should you get all the points and the big fine that goes with it--all i want you to do is slow down

2) it's a favor to you if your attitude is half-way decent. i'm not talking about kissing butt, but being pleasant and respectful. you don't have to think that the ticket is the best thing ever, but i give EVERYONE a break if they treat me decent--usually that includes a warning. have to do a lot to get a ticket from me.

3) it's a favor to me. i know you were doing 85 mph, but if i write you for 9 over (74), then the prosecutor only has to prove 74 instead of 85 mph--and he likes that, which makes him like me, which makes my job easier.

please note that when a defendant wants to challenge the ticket (plead "not guilty"), usually the prosecutor uses my notes to charge the defendant with the actual speed i clocked him at. and usually the judge will find the defendant guilty of the higher speed, which means more points and more $$$ the defendant has to shell out.

happy speeding! seriously though, be careful out there (especially with that recent IIHS study....LOL), both in terms of your safety as well as the other cars on the road. dead and mangled bodies being pulled out of cars are no fun.

quickdraw - It's nice to see a cop tell it like it is and not come on like a ball buster like some the others that like to post about how big and bad of a cop they are. You win the gold star for the day, ok, make that the week.

Question

Quickdraw you're one cool cop. We need more like you, but in overall fairness I believe that one could question the legality of citing them for one speed even though they were not doing that speed. It's almost like writing them up for 20 over when they were only doing 10 over, but in reverse.

Sure, I'm a total asswipe for saying this and I deserve a ticket from you when you pull me over (please, I beg for mercy, lol), but honestly I feel that when it gets to actual written law I believe that citing someone for something other than what they were honestly illegally doing is questionable in a court of law.

Now, anyone who wants to argue this is crazy IMHO, and any lawyer will tell you to shut your trap and take the ticket, but there are a few out there, I'm sure, that would question these ethics. I also find it odd that a judge can say, "Well, if you plead guilty I'll charge you for this speed, but if you plead innocent you're *** is screwed and I'm charging you for the higher speed listed in his notes". The prosecutor would be trying cases like these based on incorrect #'s and evidence clashing.

Like I said, I'm an asswipe for even arguing and I PROMISE you I'd never do that if you pulled me over. I would just please not guilty and hope you do not show up, and if you do I'll ask the judge to allow me to reverse my plea and be on my marry-way, LoL. Anyhoo, can I go now, sir?

Bubba

hey quickdraw..
i got a ticket once and the cop took it down quite alot b/c supposedly he liked my exhaust setup on my stang asked me alot of questions about it. was clocked doing 112 in a 55. he took it down to 85. i went to court and plead not guilty, just so that i could lower the points. but when i got to talk to the cop before the judge came out i told him everything and he knew and then he took it down to 62 in a 55. i just didnt want the points! i didnt mind paying the huge fine.

thast really cool though that you cut some people a brake. alittle respect goes a long way. watch out for those crazy people though!

hey RTKILLA- i love cars and speed. can NEVER get enough. your first mistake-you went out looking! dont look for miss right. let her come to you. when you least expect it you will stumble upon the girl of your dreams. as corny as it sounds, but its true. you are so young..live life! you only get 1 shot! i should know. i finally found the love of my life! and he loves cars/trucks and speed! i cant wait till we drag race together, LOL. nice ram air hood by the way.

Hit a Jackrabbit one night doing 130-135, was doing 140 when I saw it. I tried to hit the brakes but I thought better of it. All I saw in my mirror was a red cloud. I'll bet that rabbit didn't even know what hit him. The bummer part was after digging rabbit parts out of my grill I noticed a rabbits foot sticking out of my drivers side fog light. I left it there for good luck until my new light came in. The moral of the story is the turtle probally crossed the road a half-hour after I hit his opponent
