Standard form letter for failure to pay. Make sure you send your letter to them certified/return reciept so you can keep a record of your contact legally.

You really don't even need a lawyer. It's policeman error. I got off of a ticket for the wrong color of the vehicle being put down. Love those loop holes.

All that for a 10 mph speeding ticket? Sounds like that cop was having a bad day.

I wouldn't worry too much about it, just do the paperwork.

Constitution or not, $75.00 just isn't worth the hassle.

WHAT04 - $75 dollars is like one million dollars to me right now since all my money goes toward hospital bills, and medication. It's not easy, and every dollar counts, and I refuse to let them take it unless they have good reason. Otherwise they can try to pry it from my cold dead hands before I give it to them.

*******IMPORTANT******* If you do pay the fine, pay 2 or 3 dollars more than the amount of fine. they will send you a refund check. Don't cash it! Rip it up. Points or convictions are not put on record until ALL transactions are final. If you don't cash the refund, the transaction is never final! Lloyd

Just pay the ticket and stop whining.
FYI -
The trick Loyd mentions only works in theory. In most states/municipalities, even if you overpay, they simply issue a refund check and move on. The fact the check does/does not clear means nothing to them. In fact, most of the checks used have expiration dates on them. Once the case is adjudicated, the court forwards the notification paperwork to your local DMV for processing.

Hello Everyone,
This is a "serious" issue.
My GF Suzanne aka sxyscorpio received a speeding ticket a few weeks back on October 10th, 2000, and decided to request a hearing on November 2nd, 2000.

This is the response we have received today on November 21st, 2000, after having sent in our hearing request.

Please advise, and give us any advice you can. This is the message I am "going" to be sending to the RMV. The phone number I have for the RMV is 1-800-858-3926

DOB: 10/01/78

You are hereby notified effective 12/15/00, your license/right to operate a motor vehicle will be suspended, by automatic application of law, because you have defaulted on assessment and fines noted below:


Offense Date: - 10/10/00
Default Date: - 11/14/00
Citation: - h4968670
Offense: - Speeding
Location: - Longmeadow

Assessment:
75.00 Fee
30.00 Late Fee
10.00 Release Fee
-----------------
Total 115.00

In order to avoid this pending suspension you must mail your check/money order for the assessment above, with a copy of this notice, to the following address: RMV citation-payments, box 199125, Roxbury, MA 02119-9125 or contact the registry office nearest to you before the effective date of the suspension noted above.

If you fail to comply with these instructions before the effective date of the suspension, your license or right to operate all motor vehicles within the commonwealth of Massachusetts will be suspended and your right to renew your registration will be denied on that date without further notice.

When you license or right to operate has been suspended, you must cease to operate all motor vehicles until your license or right to operate has been reinstated. During this time, you may not apply for a license or learner's permit. If you are non-resident, you must cease to operate all motor vehicles within the commonwealth of Massachusetts.

I requested a hearing regarding this circumstance on November 2nd, 2000. The citation was received 2 days later. This would be November 4th, 2000. I am awarded the right to speak in my own defense by the constitution of the United States, and I clearly indicated that I would like a hearing. I now receive this statement above on 11/15/00.

Please advise as to how you would like to proceed, as I clearly will not pay the amount allocated until I am at least allowed to present my case.

I would like a phone call regarding this matter immediately. If I do not hear from you within 48 hours, then I will be calling you at this number: 1-800-858-3926

I will do whatever is necessary to ensure that the Massachusetts RMV's mistake is not imposed on me as a citizen. If we can not find resolution regarding this issue, then I will have to contact my lawyer.

A copy of this message has been made, and will be kept on record by myself. You will also receive another copy of this message by certified mail, within 5 business days.

I would also like to make it clear that Suzanne was pulled over on Columbus Day at 12:30AM in the morning doing 55mph in a 45mph corner of Interstate 91 crossing from Massachusetts into Connecticut.

The officer who pulled her over was a "Longmeadow" police officer, and upon issuing the citation had put down that Suzanne was driving a Pontiac Grand Prix, which is incorrect. She was driving a Pontiac Grand AM.

Hello Everyone,
As usual I would like to thank everyone for their suggestions, and comments.

I received a call this morning from a women named Madeline down at the RMV. Turns out my letter via e-mail "was" shocking, and was constructed in a manor that persuaded them to simply drop the case. I don't know how that happened, but I'm very happy with the entire outcome.

I will still be sending a certified copy of the letter to Madeline to ensure I have legal documentation. She said terrific, and we hung up saying "have a great thanksgiving to each other".

Hey MB glad you are feeling good enough to enjoy your computer ,I know you have been through alot.on the other hand,I feel the need to speak up here a little.it seems that you have been whining alot on here since youve been back for a couple of weeks .Chill out a little and relax.Life isnt fair,im glad you got off but i hardly think this issue is so important to anybody except you.No real reason for you to post on everything that happens in your life.Its very self centered.No need for an (IMPORTANT) must read memo to all of us.no flame just kinda tired of hearing about non L issues.A little too personal

MB, glad to here they dropped it. Most likely since you requested a hearing they found that they had ran out of time due to you having a right to a speedy trial (30 days from receit of summons for a minor misdemenor).
LQ, isn't this what the board is for?
IE. exchange of info and advice
