Anyone ever been sued after an accident?

Just got my summons today . BS is all I can say. Last year I rear ended someone when it was raining out. Speed was around 20 mph. Needless to say I knew this day would come because they were both holding their necks like they could already feel the "whiplash". They are wanting to take $15,000 out of my pocket a piece!! WTF!?!?!?!?! You should see what their lawyer has written in this filing, it's downright hilarious. If I had a scanner I would post it, but I don't. Anywyas just wondering if anyone else has had this happen to them.

makes youi wish you hit them hard enough to warrent such a thing or a coma

LOL, I was just a smart-*** to your new thread also. Karma works in weird ways.

Anyways, yes I have insurance, they will take care of it. It was just weird getting that summons.

wasn't sure if it was different in other states.......but i think everyone requires at least collision. Here in massachusetts in know collision is required and if the vehicle is still financed you have to have fire, theft and any other freaking thing they can find to put on there.

isn't that why you call the ambulance and police to any accedent, no matter how small (other than a love tap in a parking lot) That way you have instant medical attention and prevents people from drawing up all kinds of crap...

It's the ONLY TRUE No-Fault State!

The only thing you can sue for or be sued for is a $500 mini-tort (basically to cover your deductible)


However, it's common that if you rearend someone you weren't in control of vehicle for the conditions. Doesn't matter if it was dry pavement, wet pavement or ICE. In Michigan, if you rearend somone you automatically are at fault. Even if they lock up their brakes to avoid a chipmunk in the street and you hit them.

I'm not sure where you live, but here in Michigan, we expect people to be in control of their vehicle and operate it in a safe manner.

I'm pretty sure that is expected by everyone in the continental U.S.

I live in Illinois. A state where your the one at fault, no matter what, if you rear-end someone.

Did not need to call the police, there just happened to be one sitting at the intersection where the accident occured.

If the 2 people are really injured, suing is their only way of recourse. Most ins. companies are willing to let it go to court instead of settling anymore. So don't be pissed at someone because you werent watching where you were going. If they're scamming you, let a jury decide.

I was summoned almost 3 years after an accident and sued for 375,000 dollars. My insurance only covered me up to 100,000. Even though the guy was faking it (in my opinion), the insurance company settled out of court for around 60,000.

I have since raised my insurance coverage It's really not much more expensive to have really good coverage.

Hey if you hit someone they go for the brass ring,it's like hitting the lotto. I backed into a little old lady one time and she filed with my insurance over and med cost (just little scratch on the hood and bumber while backing up) So if you hit someone from behind you are following too close thats the law,if the fool in front of you spots for a ant crossing the road you are at fault.I've had people before make a sudden stop for a turn while doing 25 mph in front of me (close call) and in bad weather it gets bad for they don't think about the wet streets. Drive safe and keep some links from other vels.

Not true. My daughters car was rear ended in Ypsilanti about a month ago and no tickets were issued.

NUM-NUTZ, I got the same summons once for rear-ending someone. The lawyer stated that his client was sueing me cause she couldn`t ski or have sex. I turned around and said that if she wanted to have sex, I would be glad to. They didn`t laugh. In the end, my insurance gave her 12 G`s for her hardships.

I've been - but insurance took care of it, so I don't know the whole situation. Back in HS, a girl ran a red light and I hit her (it was a wide intersection with no-delay traffic lights, so I hit her going 40). I was in a '91 Bronco - she was in a little Isuzu truck with only 600 miles on the odometer. I hit her in the front quarter panel and spun her a few times and into a truck that was sitting in a far outside lane.

Anyway, the cop writing up the report was a MORON or friend of the girl's family, as he had me completely at fault, out of control, and hitting both of the other vehicles. Funny, seeing that after supposedly doing all of that, I wound up in my same lane facing the correct direction with only a cut front tire and some damage to the driver's side headlight area and quarter panel.

All I did was go before the judge wiht my case. Being a small town, I'd known the guy since I was a kid and went to church with him. He looked at the report and the Brady Bunch-style diagram I'd made and said "Duck, you're a good kid - you wouldn't do something like this." "Besides, Officer (can't remember his name) is no longer with this force and, truthfully, we don't know where he is, nor do we care." "You'd fight this in a trial and he wouldn't show up, so I'm just dismissing all charges."

However, because the cop filed the initial report incorrectly, the girl saw it as her chance to cash in and sued the whole world. The insurance company fought it and won (twice). About a month or two after her crap was quieted down, the third guy in the accident sued me, as well. He was shot down, too.

*Sidenote - this was during my senior year in high school - the girl in the story was a year older than me and in a nearby junior college. The girl who caused the accident was driving a new truck because her roommate was driving this girl's old truck and backed out of her driveway in the path of an oncoming 18-wheeler. Unfortunately, she was killed - needless to say, the truck was, as well. Anyway, you'd think that after something like this happened to someone close to you that you'd pay a little more attention when driving.
