Red face Warranty question for Superchips_Distributor.

Hi Superchips_Distributor:

I have a warranty question for you. When I purchased the HD, I was told that the dealership no longer sells warranties, they now sell extended service contracts. When looking over the contract (that I foolishly purchased and now will cancel) I noticed that it states that if any mods are done to the engine, (After market MAF, Headers, free-flow cats, etc), it would void the service contract. It also states that if the vehicle is used in "tests of strength" or "speed contests" the service contract will be void. Is this a way around the warranty act? By no longer calling it a warranty can they get away with voiding the contract if mods are done?
thanks,

Lanna (devlishz)

That's a bunch of bull !!!!!! I'll try and find the laws pertaining to add ons and post....... They have to show due cause that a "Chip" or you abused their product... I have a chip..plus a Borla exhaust system on mine....

My attorney gave me the laws and a couple of cases hey lost... They will make you fight them with the expectation they have more money than you and you'll quit....John from NC

Hi devlishz,

I can't tell you what your particular dealer is doing, but I would only purchase a Ford ESP extended warranty policy, which you have the right to purchase from *any* Ford dealership in this country up until you have 35,999 miles on the vehicle, assuming you don't go over 36 months as well.

I can tell you that it is absolutely illegal to deny any warranty claim just because aftermarket parts are used, and here is a link to the SEMA web site, of which this web site is a member. SEMA is the organization we can thank for getting the Magnuson-Moss Warranty Act passed back in 1983, which effectively ended the automakers established monopoly in replacement parts. The Magnuson-Moss Warranty Act covers any aftermarket parts, whether they are just standard replacement parts like wiper blades and brake linings, to performance and appearance parts as well.
http://www.sema.org/fedleg/warranty

Another provision of the Magnuson-NMoss Warranty Act is that *NO* manufacturer can condition their warranty upon the use of only factory original brand name parts, UNLESS they provide those parts completely free of charge.

It sounds like they're doing just as you suspected, and playing a game by calling it something otehr than a warranty, so I would get a refund, and go buy a proper extended warranty from a different Ford dealer. Do not reward this dealer pulling this crap and selling a restrictive policy like that with your business.

Good luck!
