I wonder if that was a heavily edited video? I dont' know the Guy and am not defending him. But you never know the whole story when it comes to a video like this.

What he did was absolutely, positively wrong. Without a doubt, he should never have done that. He should know better than to try that.
























He should have simply done what former VP Cheney would have done.........



















He should have taken them hunting with him....

It happens all of the time. Half of the legislation passed over the pass one hundred years is an assult on all of the citizens. This time it was more narrowly directed and also caught on tape.

To me it seems the not-so-esteemed congressman is more than a little bit drunk. Notice how glassy eyed he is and how he slurs his words plus the classic, "Whu you arrrr." The guy in the video should come forward and press assault charges and also push for a public intox charge as well.

As soon as he refused to let my hand go when told to, he would have had a good-n-proper beat down. All requirements were met for a battery and everything I would have done would have been aggressive self defense.

Going to the extent of the law, in the state I practiced, it could have conceivably gone very bad for the Congresscritter. Three crimes were committed by the critter, a battery, a false imprisonment, and a kidnapping. The kidnapping puts deadly force used to protect oneself from the commission of a forcible felony on the table. So going to the extreme extent and depending on how the person articulated the situation, the Congresscritter could have legally been killed. Personally I would not be able to articulate the situation to make the killing legal, but that is just me. Someone else might be able to do.

That's kind of a stretch, but from what I've learned in all my law classes, you could try that except for the false imprisonment. I'm pretty sure a jury would still find you guilty of killing a Congressman just because he wanted to hold your hand.

Assuming the video is accurate, those are the crimes I would have charged him with. All of them are based in the criminal code. The grabbing of the persons wrist is a battery, and is reinforced when the kid tells the critter to let go twice. The failure to allow the kid to leave is the false imprisonment and the grabbing the kid on the back of the neck and moving him to the critter's side meets the requirements of a kidnapping. All three actions meet the elements of the crimes.
