Question Tax Help Quick!!

Ok. Not to air my dirty laundry out on the forum, but I have a tax question. My wife and I signed our divorce papers on September 10th of this year. In Pennsylvania there is a 90 day waiting period before the divorce is filed at the courthouse and becomes final. This would make the divorce final roughly December 10th. In an effort to rid myself of the crazy woman, I would like to just file my taxes separately from her. That way I don't need to deal with her at all. We never had any common interest bearing accounts, no retirements, the house has always been in my name. We have no children so there are no ties whatso ever.

Can I just tell her that I am going to file my local, state and federal taxes on my own and she can do the same? I don't care if I get less money or no money at this point. Any suggestions would be appreciated.

"Married, filing separately" is the way to go.

Thanks Dave. If the divorce is final by the end of the year though can I still file married, filing separately since I will actually be divorced??

Why tell physcowench anything? Just go on about your life and file your own taxes. But do it early. I had the same issue a few decades ago and that's what I did. It also cost my ex a ton of money because she couldn't take advantage of the property taxes paid, mortgage interest,etc, that I accumulate.

If you are officially divorced by the last day of the year, you must file separtely. It is determined by your status as of midnight 12/31.

Thanks Jim. That's what I thought considereing our divorce will be final by December 31, 2009. Yay, one less thing I have to deal with her on.

On a side note. Don't ever, ever, ever, ever, ever get married. EVER!!
