Exactly, you know beating the crap out of her would be wrong, if you got caught, you shouldn't be looking for a how to get out of jail free how-to, and if you did, you can expect everyone to fawn all over you with advice.

Josiah says he had an open container in the vehicle, with people under the legal age in the vehicle, and that he himself "had a few", this is after running a posted stop. That's four broken laws right there. He had doubts about just how many he had, or he would have blown into the breathalyzer. He hasn't shown any remorse for putting other people's lives at risk, nor has he said he learned his lesson and won't do it again.

Some people are looking for sympathy and advise on how to get out of it? Give me a break.

BTW, I never use the beer bump...unless its a special occasion.

I agree with Drew... I see Stop Signs as more of a guideline than an actual hard and fast rule...

I arrested a guy last night 12/4 for public intoxication and criminal trespass. The guy didn't remember me or the criminal trespass warning he had signed while intoxicated on 11/20 which was issued by me. He also didn't remember the second warning another officer had issued him on 11/30 not knowing about mine.

The reason I bring that up is all of the responses in this thread are based on only one side of the story and that's the arrestees. I'm not casting judgement because I wasn't there but one thing that I have learned in my career of DWI enforcement is you can't put much weight on a drunks testimony nor can you rely heavily on their memory the next day.

If they stopped you for any reason be it a red light or a license plate lamp and you or anyone in the vehicle smells like alcohol that's reason to do further investigation. If your passenger smells like alcohol and is underage then that's more then enough reason to go into a second investigation for providing alcohol to a minor which is a higher charge then the original DWI.

Either way wait till you see the video in court, it may jog your memory a bit. I also wouldn't trust your tipsy or drunk friends relocations for the same reasons mentioned above.

I have a question for those that say they would always refuse to submit to a breath test or field sobriety test. How would you suggest the officer determine the sobriety of an individual that won't submit to testing?

Smart move by not breathing. It has been proven that listerine can make you go over the legal limit even with no drinking. So never blow the breath test. Hopefully you got your license back and the lawyer can get everything dropped.

A DUI will stay with you for life, and can keep you from getting jobs. I think you did a good thing

I came on here for unbiased advice, so of course I am not going to show my emotions knowing people who feel the need to kick people when they are already down, are reading. The only thing I have even told my friends was that I am glad I was caught, I needed this to change my life. I am going to be hurting for a long time after this thread is over regardless, but I would like to examine my options. I know there are people out there who don't deserve the lesser charges but at times decent people have been known to make big mistakes and I'd like to think that is why those sentences are sometimes given.

Thank you guys for the advice, I'm sure you all (including those with hate in their veins) would like to know my fate so I will keep you my friends, informed.

For the record this is the most embarrassing thing I've ever done.

Interesting... a lawyer in Ohio had this on his website...somewhat contradicts what you write:

Myth No. 2 - You can make it harder to prove you're DUI by refusing to take the breathalyzer.Implied in your right to drive in Ohio is the "implied consent law." This law states every person given the right to drive in Ohio agrees to take a breathalyzer when asked. There are severe penalties for refusing to take the test. There may be legitimate reasons for not taking the test, but you should be fully aware of the ramifications of your failure to take the test and compare that with the possible adverse outcome of the test. When in doubt consult an attorney
