I have a question for the police officers on the board...
Is it legal to drive and consume "non-alcoholic" beer (0.5%) out of an open container? I'm not asking so I can do it (ewww), it's my ******* neighbor who does it all the time. He calls the police on me for trivial BS all the time, and he's a police officer...I'd like to have something against him should it ever be required

In Texas, a value of less than .5% Alcohol By Volume is not considered to be an alcoholic beverage. Near-Beers fall within this range.

That stated, a person who test at .08 or greater is legally impaired to operate a motor vehicle. It is not uncommon for a pull over to present a "near beer" to explain away the beer odor on his/her breath, but actually be intoxicated.

Honestly, I don't know (havn't worked patrol in over a decade). I'm sure it varies state to state, but I don't think there is a special exception in Ga. Like mentioned, it's not "non alcoholic" it's actually "low alcohol" beer.
This is according to the truck stop I worked at....
"Non-alcoholic" beer still falls under the same regulations as alcoholic beverages (in the state of Montana). Therefore we cannot sell near-beer to anyone under 21, and the open container laws still apply.
