12Mil in "damages" because a 59k car may not be as valuable? How does that math work out. I hate people like this, always looking for something for nothing.

It's a class action suit, lawyers get half.
Drew Conner of Bardonia, N.Y., and at least 100 other people are members of the class seeking a jury trial and more than $12 million in damages.
12 mil divided by 2 = 6 mil
6 mil divided by 100 = $60,000

thats so stupid. if they were to get anything, all they should get would be the price of the car. and then they would have to give the car back. they could call it a "return". its a pretty standard procedure in most businesses.

and if i read correctly. they only made 100 2007's. thats probably what ford agreed to. the 100 2008's are totally different cars. just like my 2007 isnt as valuable as someone elses 2008 truck.

No way.
Maybe if I was investing and only 100 would be made.

What do you mean "Oops!...Now it's 200...and 100 of them are newr than my mine?"

I was unaware the lawyers got half, although it does not surprise me. My point was it is too much money. So pretty much they feel they should get the car for free, they are asking about what they paid for it. I hope Ford wins

You have to ask for too much, to get what you deserve. The lawyers usually get 1/3 of the settlement, and then give you a bill for their services. lol What a racket.

As far as it being too much, I think punitive awards are okay. The threat of them helps keep businesses more honest than they'd be without them. If breaking even were the worst thing that could happen to you for being dishonest, then who wouldn't be pushing the envelope all the time?

Raoul ran down the math and the 60k was after the lawyers fee's. I personally feel thats too much, thats just me.

It's not like the price of a Mustang is an unknown.
They start at what? $16,000 and go all the way to what, maybe $31,000?

Ford was selling these 'Limited' Mustangs for $59,000.
Both seller and buyer realized the price was directly due to rarity.

Let's say you have a Fifth wheel that weighs 12,000 pounds.
You agree to buy a Super Duty from Ford because it tows 12,000 pounds.
Later, you hear that the tow rating is no longer 12,000 pounds, it's 6,000 pounds.

Sue?

Not at all, it did not have the extra price because it was 'limited'. It is a package full of performance options and that is the reason for the extra cost, the fact only 100 were made was icing on the cake.

If they win? Looks like an open and shut case.
Papers were filed in New York, where a civil jury can throw out the judgement and insert a greater figure, such as additional Pain & Suffering or other punitive damages.
