Anyone filed a small claims lawsuit?

Anyone filed a small claims lawsuit?

Has anyone taken someone or been taken to small claims court? I'm going to take the owner of a local business to small claims court for screwing up a clear bra on my car, but I don't really know what to expect. I know I have to look up the business license to find out who the owner is or atleast who is listed as the owner. I know who the owner is, but I need to find out if the business is in his name or his wives name. How long does it take after the suit is filed to actually go to court? It's going to be through the Little Rock Arkansas courts. I have a little digging to do and will probably file the suit on Friday, but wanted to know if anyone has any info that would help.

Based on my resources at work, I should be able to get you whatever you need as far as who the owner is, what name they operate under, etc... If you give me the company name, I can see what I can dig up for you. If you don't feel comfortable posting it, just PM me.

Thanks for the help JK007. Anyone else have any idea how long it takes after filing the suit till it would go to court? Any experiences in these types of suits?

The problem with small claims or any court for that matter. Once you get judgement then the next problem is collecting. In most cases that cost you more money. Question is "is it worth it?".

To me it is worth it. I'm already screwed if I take what he is offering; a refund of only the installation charges. That leaves me holding the bag for 500 plus dollars. I tried to get the owner of the business to refund more than the installation charges but his only response was he would put on a new kit if I bought a new one. They already messed up one kit, I'm certainly not going to let them mess up another one. I guess if I let them try again and they messed up again I would have to buy another kit... this process could get very expensive. I'll take my chances in court.

For me it's more a matter of principle now than money. If this guy is trying to get one over on me then he is probably doing the same to someone else. I want him to think twice before he tries to low ball and rip someone else off. Hopefully I get what I feel I deserve or at least inconvenience this guy enough to think twice before he tries to pass of shoddy work. I think the worst part about the whole deal is my car looks like crap and I have to leave it that way until I go to court. I really don't drive the car much, so it may just sit in the garage until a court date!

I've delt with people like these before. My question always comes down to the dollar.
He will pay, "what goes around comes around".

If you've have never been in court be sure to always respect the word coming down from the bench. Present your case and let him do the rest. "Law is justice without passion". [It's not pledgerizm, I'm just to lazy to lok it up}
