Another stoop3d question...

If one has to pay child support, and it is being directly withdrawn from your paycheck, does the company that the person works for have the right to charge that person with a $10 "processing fee" for each paycheck ($20 a month).

It's a state requirement that the person have to pay child support, so the company is taking advantage of that person, IMO.

I'm no legal guru, so that's why I'm asking.

no it doen't seem right,but to the company can view it as a "non-company issue" that requires extra staff time.. so it feels the need to capitalize on it..

No. When they try to capitalize on an employee thats not right thats just wrong on so many levels. I would speak to an HR manager or Pay roll Marnager.

Nothing like profiting off of your employees problems Grrrrrr.

Are you sure that it is your company charging the $10 per check, and not an outside agency?

Here in Kansas they have a private sector payment center that manages all of the deductions (garnishments) and payments. With that comes a processing fee as well.

I negotiated it that the processing fee be split 50/50 between my ex and I.

While I think it is BS, that is just the tip of the iceberg for me. My biggest concern was the garnishment. Unfortunately there are a lot of people out there that are not responsible enough to make their own payments. So those of us that do, and are responsible, get the privilege of seeing "GARNISHMENT" on our paycheck every two weeks.

If the company is charging $10, it might be part of a bill from the agency handling the support payments.

I would definitely look into it.

It was a letter from his HR/Payroll dept of the company, and not an outside agency. When I read the letter sent to my buddy, I was shocked.

What gives that company the right to charge him that fee when the STATE is making the requirement for him to pay? I can understand if he was splitting his check up and sending partial amounts of his check to make payments on his house, truck, etc.....but this is the Attorney General requesting that $400+ a month.

Doesn't sound right to me, and it appears as though his company is taking advantage of an employee. He said he'd talk to HR about it, and take it from there. Needless to say, he is looking for a new job.

bah pay the child support and there would be no need to have the check docked. I thought they only docked your check if you were late on payments.

They can even fire you for it.

I agree completely Vader.

However, in Kansas they Garnish your wages period. They don't allow the people that are willing and able to pay it on their own, do just that. They assume everyone that pays child support is a dead beat. MEANWHILE, those that don't want to pay change jobs every 8 - 10 weeks until the CSO (child support office) catches up with them.

No, no....he is paying his child support, and not missing any payments. He is being charged a $10 processing fee by the company.

Most states allow the company to charge back the cost to the employee. Our company does not, even though we do have the "right" to. Just a decision I made, and I think it is the correct one.
