Advice on DWI...please no bashing
 
Like I said please no bashing...I know what i did was wrong and that I could of hurt sombody. Please don't post if the only thing your gonna do is lecture me.

Well its been a long time since i've posted on here but i still visit everyday. I don't know if many of yall remember me.
But anyways to the situation. Last night I was coming home from Greensboro on 29 in my mountaineer. I have had about 3 or 4 beers at a buddy's house in Greensboro while playing poker. Well on the way home I had the bright idea to see how fast the mercury could go on the straight-away. Yes i know i'm stupid. Well right as I was about to slow down their was blue lights behind me. I put my emergency flashers on and pulled over right away. He clocked me going 105 in a 65. He then put me in the front seat of his car and administered a breathalizer to me and when i failed he put me in handcuffs. (FYI I am only 20 years of age and their is a zero tolerance) When we arrived at the police station and he administered the stand-alone breathalizer in which i blew a .12. The legal amount for a person over the age of 21 is .08. I ended up being charged with DWI, 105 in a 65, and reckless driving. I am going to be in touch with my lawyer first thing in the morning.
By the way the officer was nothing but nice and respectable to me the whole time. And i showed him the exact same courtesy. He allowed me to ride in the front seat with my handcuffs in front of me and make some phone calls the whole way to the police station. Showed me nothing but common courtesy and at the end of the night i shook his hand and showed him my appreciation. But the reason im posting this is because I know their are some smart people on this forum and could give me some serious and helpful advice on how to deal. But I also want people to know that it isnt worth it. Not worth the hassle, the trouble, the concequencess. Its just not worth it

Best advice? Bend over and start saving, this is gonna hurt. You effed up, but are smart enough to realized what you did was wrong and that it really is your fault. If you have a clean record before this, you might get some kind of break.

Get the Mountaineer listed in the autotrader, cancel your auto insurance, and get a buss pass. Sorry to sound like a jerk, but seriously, you won't be able to drive or AFFORD to drive for a long time.

Aside from that, you really don't have a whole lot in your bag of possible tricks. The only thing you did right was respect the officer, which, sadly, won't get you very far here.

This is the best advise you will ever get.

You don't need a lawyer...all he is going to do is the same thing you can do. You were busted and now the only thing to do is plead guilty, pay the fine and take the punishment the judge will be giving you. The only thing the lawyer will do is take your money and talk sweet to you to make you feel better...you will need that money for your new insurance rates.

Your only 20 so you have time to recoup and continue with your life...you feel bad now but things will get better.

Do this and you will be fine. Just learn from this.

Since this is your first offense, your state might have a plan that you might be able to take advantage of for 'first time DUI/DWI offenders'. As part of the process you are going to begin, you will be assigned a counselor/parole officer while you are suspended. Make sure to ask about it and get into that program if available.

I arrested a older guy (late 40's) last week for driving on the wrong side of the road, while showing other drivers the middle finger. He did not even realize I was behind him with Lights & Siren activated, he drove up on someones lawn, before stopping for me on another lawn! He failed a field sobriety so bad he had to hold himself up using a tree. After failing the test miserably he stated "Were all set now Officer I'll just drive home now!" He was not a happy camper when I was putting the cuffs on him! After reading him his Rights! Sounds like you were not at least a SOB like he was.............:thumbsup:

Yea get ready to have to file SR22 insurance.

The actual judgment probably wont be bad assuming this is your first offense.
Probably a fine, maybe probation, maybe community service. All fairly easy to take care of. It's that SR22 form that the judge requires and how long that will get you.

When I was 19 I got put on SR22, not for DUI but for numerous tickets.
I had to have it for 5 years. I had a 90, S10 I was paying on so had to have full coverage, the monthly payment was $188 a month for the truck. Full coverage w/ SR22 cost me $426 a month for Full coverage insurance on a 4 cyl, 2wd, S-freakin 10.

426 x 12 months = $5,112 a year for insurance
$5,112 x 5 years = $25,560 I spent on insurance on an S10 that I only paid $10K for and eventually sold for $300. :mad:
I lost $35K on that truck. :eek:

For future reference, NEVER do the breathalyzer, you have the right to deny the field breathalyzer and go straight to jail.

...but in some States not taking the breathalyzer is an automatic DUI/DWI.

When you go to court, talk to the prosecutor and see if he can dismiss the speeding ticket, or at least lower it to a lower offense.

so I thing your drink count is off If you want help don't lie to us so unless you weight is 100 pounds your 4 drinks count is off card games last more then an hour too at lest around here

I said what i said please don't accuse me of lying...Their are many other factors that play into BAC other than alcohol consumed. Including food, rate of consumption, body fat % ect. ect.
If i drank 3, then i drank 3. If i drank 5, then I drank 5. The more important factor is my BAC was .12 and you cant change that. But I told the officer I had 4 beers and he didn't seem to have a problem with that and my BAC.

in texas, if you refuse a breathalizer, they will take you to a hospital or clinic, hold you down and take your blood as evidence.

SO that doesn't work anymore.

By the time they do all that, your blood alcohol will have dropped some making it easier on you.
