Another reason why I believe that home owner associations and their "covenants" should be banned as unconstitutional. Just a group of little hitlers trying to push their idea of ideal on every one else.

We own a farm out by a lake that has been in the family for over 100 years. This has always been a dairy. When my father went in the service, (WW2) The dairy was decreased to 35 cows, it has been over 150 cows since the 1960's.
Nieghbors have sold swamp property for high dollar subdivisions and the new owners of million dollar homes don't care for the noise and smell of agriculture, or bugs. The latest covenants say you must control mosquitos and flys and oders, buildings have to be painted pastel colors, vehicles can't be left on the street over night, and lots of other rules which are not enforceable. They moved into a rural farming community.
We are not a part of the subdivision and are specifically excluded. I went to a home owners association meeting, (at thier request) and asked "Why they would build a millon dollar home next to a dairy in a swamp if they didn't like mosquitos and cow ****?" I wasn't verry popular, I guess I'm not going to be invited to any nieghborhood barbeques.

LOL! It's not my neighborhood.... thank goodness. I live out in the middle of no where. It's just a friend that lives about 20 miles away that I go to college with. His parents are pathetic and worry if they've got spots on their windows from the last rain shower that they will have to call in a professional to clean their windows.

Oh, and about that 2 bucket system... I should tell that to his parents.

Oh trust me... no one would care if you drove a dirty tank from Iraq on my lawn. Infact, I've got a heap of scrap metal in plain sight of my front yard... I would actually love to have a dirty off roadin' F-350 turbo diesel sitting in my neighbors driveway!! If anything, I'd get a hardon for it cause I want to drive it and go mudding with it.

But let me digress... when his dad was talking to me about sueing them about having a dirty truck in their driveway, I thought I better clean my truck next time I get invited over.

This is exactly the reason why I will never live in a housing development or will never be a part of homeowners association. My brother lived in brand new development where he rented a home. I don't think he even lived there a year. He mowed his grass every couple of weeks and still got nasty letters telling him his grass was too tall and they were going to cut it and charge him. He was not allowed to put up a play set for his twin 2 year olds, but a house 2 houses down had a large one and had like 6 or 7 kids running around.

I would drive my work van over and he told me that my van by the H.A. rules was not allowed in the subdivision. I was waiting for the day for someone to tell me I was not allowed to visit my brother because I drove a 2500 Express Van. But nobody ever did. Now he moved to where he has 2 acres but a way smaller house and he loves it. He can actually drive his dump truck home and park it in his own yard.

I would side with him, who knows when those creepy bastards are going to start razzing you about something, and if you don't try to take him out, he might be on your side when they give you crap.

Perfectly stated.

I would never live in those areas... why?! Not cause I'm a slob, but rather because I live in America, and if I want to park my filthy truck on my lawn or driveway I can and no one will do or say anything!

Deed restricted subdivisions have their place -- they're just not for everyone!

People need to look at the deed restrictions BEFORE they buy a home to find out if it fits with their lifestyle. If it doesn't, then they need to look for a home somewhere else -- it's a simple as that!

As a former board member of a HMO's Association I can tell you they do more good than bad as far as keeping everyone's property values high, and you have to put up with undue amounts of BS from every piece of white trash that fell into some money and moved out of their single-wide!

There are always exceptions, but I take a fairly narrow view of people who knowingly move into a deed restricted subdivision and then act like they're all surprised that they can't do this or that! Read the ****** Deed Restrictions, morons -- if they're not for you then go live where you can do the things you want to!

I pay the house payment, I pay hte insurance on it and I pay the taxes. That says that I can do anything I want even if it is a little or alot white trashy.

Currently I am storing my boat, my jet ski, my firends boat, my 81 trans am that does not run, and.... hehe a 36' 5th wheel travel trailer that I am working on all in my front yard. Currently the TT has about a small dump truck load of trash and bad interior parts that I scooped out of it sitting next to the back door (which both doors are in the front facing the road) Yea they'd have a field day trying to write a law suit on me.

Unfortunately if you signed the covenant, they can do just about anything they want, including evicting you.

They can take you to court, they can put a lien on your deed, in bad case scenario they can forclose your house. Kicking you out and taking it from you.

They are thier own little goverment, they have all the rights of a city goverment to enforce thier laws once you sign with out stepping over the city, county or state that they are in.

The really bad thing to me, is that they can make amendments at any time, and even if you dont agree then if the majority of your neighbors vote it in place, then you must abide. Just when you think they have reached the epic of silly, they amaze you with something sillier.

When a homeowner signs the HOA agreement at closing they have signed away their property rights. It means giving up Constitutional rights and control over your most valuable asset – your home. Homeowners associations are the enforcers.

Maybe we were all raised in a weird way, ya reckon?.. I've always figured that as long as my neighbors aren't running a chop-shop / crackhouse / whorehouse, whatever extreme crap, and as long as they make an effort to keep up appearances, then it's none of my business.. anyone who can't afford the wetbacks to mow the lawn has let it get high on occasion.. There's a man 3 houses down from me who every year around Christmas puts these lights on his roof about 3 feet high that say " HAPPY BIRTHDAY JESUS".. I love it, LOL.. he sure as heck couldn't do it in a HOA controlled neighborhood..
I get it that some people are just so uptight and think they know how everyone else should behave, but FU*K 'em.. their elevated sense of self-worth is laughable, pitiful really.. Pink Floyd wrote a song about them, "Pigs (Three different ones) "..

HOA are just a bunch of stuck up busy bodies with nothing better to do.

My parent are being sued by a HOA for having a fence that is 5ft tall instead of 4ft. they are winning the case because the HOA has done just about everything wrong including voting in the BOD, no bid contracts to friends and violating state laws ( you have to have a 5ft fence around a swimming pool.) they just have no idea what they are doing. they are driving down the price of the houses because people just don't want to move into a communist housing development.
