stupid ticket

stupid ticket

Ok I got 3 tickets today, but we are gonna forget bout two of them and focus on this one. It says that the infraction was a 'modifyed muffler' spelt that way and everything lol. How can he give me a ticket for that? Theres nothing illegal about having pipes on your truck. Well atleast not down here. Im taking all three of the tickets to court but what was he thinking when he gave me that. I guess this is a rant but is there any penilization(sp) for writing false tickets?

Uh.....yes there is.

316.272 Exhaust systems, prevention of noise.--

(1) Every motor vehicle shall at all times be equipped with an exhaust system in good working order and in constant operation, including muffler, manifold pipe, and tailpiping to prevent excessive or unusual noise. In no event shall an exhaust system allow noise at a level which exceeds a maximum decibel level to be established by regulation of the Department of Environmental Protection as provided in s. 403.061(13) in cooperation with the Department of Highway Safety and Motor Vehicles. No person shall use a muffler cutout, bypass or similar device upon a vehicle on a highway.

The officer could also be issuing you a ticket based on a town or county ordinance which would not show up in state statute's. As for mis-spellings, those happen. Doesn't change anything as to the charge and a judge will usually entertain your questions regarding your concerns, but in the end, very seldom does it affect the outcome. I am very generous to suspects based on their attitudes. I will gladly ask the judge to dismis the ticket with an error and I will re-issue another that is correct....

Talking Max DB for your area

Find out the Maximum Decibels level allowed for your area. Rent or borrow a DB meter from some EPA Freak, or Radio station. Set it up at a reasnoable distance to the street, and record your truck driving by. Then sit there and record Harley Davidsons DB's & plate numbers. Submit that to the courts.
I'd bet money, you cannot find 2 mufflers on 20 harleys that pass your spot.
Unless they are road kings or some other slug of a bike. Sportester, Dyna Glides, Softtails, hard tails, most have nothing but straight pipes.

Or don't. There are so many flaws with the above recommended action that I don't know where to start.

Basically, the 'Other people are more guilty than me and the cop is picking on me' arguement is a waste of your time and the judge's time as well. Judges don't like it when you waste their time, and they have ways of making you pay.

the other one was for not wearing a seatbelt(wich i was) and the other one i cant read the handwriting, he just handed them to me and im reading them now. Also, the cop said i was trespassing. It was like 11:30 at night and me and my friends were at BK and he said thats its tresspassing when your in a parking lot not conductiing business, then i told him that we were eating in the parking lot at BK and hes like 'no shut up, you talk to much' and i was like 'ok w/e'

oh but this is why i got pulled over in the first place, me and my friend kenny were parked next to each other. I was in my 3 ton 4x4 pick up and he was in his grand prix. I had my truck in nuetral because i dont like holding down the brake so when we were about to leave i was gonna leave first but i forgot that my truck was in neutral so i pressed the gas and the truck revved(my fault but not intentinal) so my engine revs and i put it in drive and i go. Right as im about to leave the parking lot the cop pops out and throws on his lights. He tells me to turn off my vehicle and get out......so i turned it off and took off my seat belt and got out. Idk where he saw me with no seatbelt but w/e.

The cop later on in this like half hour traffic stop eventauly goes 'sir do you agree that you took off in a rev like manner' and bla and he started using all these big words and i knew he was trying to say that i was racing him and i told him 'sir i wasnt racing him, we were about to leave' and hes goes 'are you arguing with a cop?' and he pulls out his handcuffs like he was gonna do somthing so i just said 'look im just stating my opinion on what happend'

sounds like you got Buford T Justice that night.

He was probably watching you guys or a while. So if he was watching you for an extended length of time just to give you minor traffic tickets... thats harassment.

Get a lawyer and have all 3 thrown out.
