Ok I work for a large (orange) retail store. I am going to quit today, but that is a whole nother thread.
They have a break room for us, which has little lockers that they issue us including locks. Everyonce in a while I will walk into the break room and find one of our managers going through the lockers.
How legal is it to do that with no one else there/watching including the person whos locker it is?

They definitely have a right to check for drugs, stolen merchandise, etc
The question about supervison Im unsure of. I would think "yeah because what if your wallet disappeared"
In a perfect world, the Mgr would be in there with the HR mgr.

Not exactly sure but... I would speculate that, somewhere along the lines, you've signed something that gives them express consent to search those lockers at any time... especially if they are issuing the lock to you. Further though, I'd speculate that they must have some sort of due-cause to do this and should probably have to notify the individual of the reason that they performed the search and of their findings.
I don't work for Mr. H Depot but, that's my theory... it'd definitely be a fair question to ask management but, being that you're turning in the orange apron, that's your call.

I'm with RP, at sometime you signed something giving them permission to search. However there needs to be more than one person present during the search, and anything found needs to be photographed and documented.
No different than your desk or your computer.
If your employer wants to go through it, they can.
If the employer abuses this 'right', then their good employees will leave.
So most employers don't regularly go through your locker, desk drawers or the contents of your work hard drive and inbox. But they can if they want to.

Just last year the Yukon Gov't went through a court battle because it has suspended/fired a number of employees because of "****" on their computers.
One of the **** e-mails was of a chicken in a bathing suit?? WTF is that?
Then again, our female HR Director (past) wanted us to remove a clock from our coffee-room. It was from Snap-On tools and pictured a couple of curvacious gals dressed from foot to neck in white, although be it snug, cover-alls, unzipped to about mid-cleavage.
I, and the rest of the crew, females included, flatly refused and told her to get a life. End of issue, and the clock remains.

It's the same way in schools, they OWN the lockers and ALLOW you to use them, they can search them whenever they want to. Now, if stuff starts to go missing, then you need to start raising flags.
