True they can use their might to get the bill axed but short of that it is a huge pain in the rear for ISPs to try and enforce this legislation

I think if any part of this bill that will not fly is part 3. I don't think the legislature will find it reasonable for the forum operator or ISP provider to provide the information of an individual to anyone. If anything, they will say that a court order must be received before anyone releases private information to someone.

Part 4 most likely will then kick in if a provider does not provide the information after a court order.

Part 2 only states that a provider will require those who register to register a legal name and address. For a provider to prove a legal name and address of someone who is registering will require them to obtain information that is protected. I think that if a provider takes reasonable care in maintaining their list and looking for obvious false information, and address those folks who provide false info, then the provider can not be held liable.

The Statement sayes that a provider must establish a reasonable procedure to obtain the information. It also states that the provider is only to be held liable IF the list in not maintained and the informaion not turned over. (Again, I don't think they will require the infor to be turned over without a court order.)

The first problem is that there would be genuine issues as to whether New Jersey could apply the law to any forum operating outside of New Jersey. That issue alone would gurantee a battle in the courts for years.

Secondly the DMCA provides reasonably qualified liabilty protection for forum owners that would supercede state law, that issue would also be in the courts for years.

Bottom line, is, if they pass it it will be immediately challenged by the ACLU along with several other entities, which at the very least will guarantee the law will not be allowed to take effect for 5 years minimum if ever.

How about the LT CLAUSE: Anyone who became a member of F-150 prior to May 2005 is exempt from this ammendment.

Of course I do. And it was discussed....very early on when I first purchased. I do not post any pics anywhere on the internet. That's just me. Why, are you doubting my sincerity?

Not offened. I just don't give out too much personal info. about myself. But I will say, pretty much what you see here is what you get.
