hurt at work sort of

Before i was hurt, I was taking out a bedroom set. Real heavy stuff. in another customers house-- As we were walking by them taking the stuff outside, They began to smoke pot in front of us. They asked my partner if we wanted to take a hit and of cource we said no. when we went back to the store i asked again ( which i had done in the past) if we can tell the customer to stop doing that. He said no, you just have to live with that ( them doing a unlawful thing) and just keep working around it. So the question comes again, should i have asked the customer to move the stuff out of the way in the house i got hurt in??( which would have taken hours ) yes i should have but we are not allowed to ( tick ) off the customer.

I just threw out the question should i go after the homeowners insurance, it was just a question, not like i have a lawyer right now to do it. I highly doubt it if i will go that route. less than 1 percent-- My sister in law does legal contract stuff for nation wide (is on your side) and brought it up to me (about suing)

Am i going to have a mri on my wrist done, yes another sister in law thinks i have ripped some tendons in it and need to have it looked at by a specialist.

Most businesses have some type of client confidentiality policy, and a GOOD rule of business is that if you see something and it ain't hurting you or anyone else ignore it because it isn't anyones business, more so if it's in someones house.

On the other hand, the customers should have used a little discretion, I have no problems with someone lighting up in the privacy of their own home, but common courtesy is just common courtesy in general.

I would have asked him if you could move enough to clear a path, I doubt that would have taken hours, a dryer isn't that big and push it off on the need to make sure his property or the merchandise doesn't get damaged.

Actually you stated in your original post that you were going to "play this up more", odd thing for someone to say if they are intending to milk something for all it was worth. Unless your sister in law is a practicing member of the Bar and is willing to represent you non-gratis or a contingency, I would take what even she says with a grain of salt.

Here's another tip that generally does people well. Don't do business with family, don't get business advice from family. rarely does any good come of it.

Then the WC doctor needs to refer you and and what compensation WC decides to give you is what you end up with when it's all said and done.

Just a thought, I've had one for years, a supplemental disability policy can be a good investment if your employer isn't the type to step up to the plate and do the right thing.

Thanks everyone who responded to my questions, but everytime i respond to other comments i am put down more-- even to the point of how long it would take to clean out the basement walkway to make it safe. I was in the basement, i saw how bad it was, it will take hours and some guy in Iowa says he doubts this.
What i have learned from this forum in the last few days is people like to find fault in things and people and jump on it. I am someone who looks at both side and can be changed from what i thought sounded good at one point, but someone said something else, i can go with that.
A few years ago i asked people on this forum if i should work for walmart or cvs as a asst manager. That was much more informative back then, then this questions i had in this question.
I am guessing someone else from IOWA will jump on this and say i cannot take criticism, yes i can and i can even listen to what you ahve to say. But if i say something is going to take a few your to clean up. You should take that to be the case and not say it is not.

I will not be posting on this subject anymore. It has bothered me to read the comments anymore. It makes me want to buy a chevy.

Dang you are shallow!!! You post stupid questions AND comments and people reply with stupid remarks and you think it has something to do with their vehicle preferance.

Look, as they say , hindsight is 20/20...I'm sure if you think about it now, you really should've asked the guy to clear a path. You didn't, oh well, its over. Your comparison to the guys smokiong weed, is way off base and is, in no way, the same as asking the guy to move some crap. You got hurt..fill out the report and do as the doctors tell you to do. Any respecting company would help you out with pay, if you are only out for a day or two and cannot collect workers comp.

Dont get mad, when everyone jumps on you about this. You said in your first post you want to milk this for what its worth, and talk about how your divorced and pay child support..bla bla bla....it just doesnt sound good. Go back and read it again, make believe it was me that posted it and then see what you think.

As far as sueing the homeowner or your employer...forget it. NJ Workers Comp. protects the employer. They also put a monetary value on each body part and the percentage of the loss. Forget about pain and suffering..not gonna happen. About 10 years ago, I fell at work and shattered my ankle. I was out of work for 14 months. It was totally my employers fault...giving me crappy equipment to work with. I was unable to sue them because they were covered by law under workers comp. What I was able to do, was sue workers comp. for what my injury was worth according to NJ law. So they pulled out a chart and said..OK,,,one ankle...25% loss of movement..umm, you get $20,000. So thats what I got...but ......that was the total payment, so they were still paying me the 60% of my pay each week for 14 months so that was all deducted from the 20K. By the time I got the final payment, it was like $2500 if that.

NJ, really protects the employer in cases like this. I say, make sure the accident report is filled out, see the doctor and do what he says. Dont try to milk the system..you will get caught....then it will cost you alot mre than 2 days lost pay.

Well it looks like you are just looking for some quick cash and we are just being honest. Your case looks weak from our view and we are not even lawyers.
