I dont see why he has to have the actual to have a case. Can't you just take a large number of photographs? I'm sure the guy who lost his finger would do anything to help if the guy would have just threatened to keep it.
I like the fact the fingerless guys lawyer said not to talk to the press. Which tells me they are sitting back and waiting to see if the "victim" gets any money from the ice cream store. Then turn around and sue him for pain suffering, mental anguish, and anything else they can. Basically making the "victim" the middle man...too funny, should have just given up the finger.

Something here isn't right.
This sounds like a dangerous machine. Sounds like they need a lock-out, tag-out procedure when it comes time to clean it out. If Mr. Finger wasn't given proper training, including putting the machine in a zero-energy-state before sticking his hand inside the thing, the ice cream shop owner could be in trouble.
What I don't understand is...if Mr. Finger was cleaning it while it was running...then gets his finger cut off, why were they serving ice cream out of it? Unless another worker finished the job...it wasn't properly cleaned. There had to be a lot of blood in that ice cream. What...did they rush him to the hospital while someone else kept making cones? Other customers MUST have noticed that the bloody soft serve had an odd taste. I'd like to hear more of the story.

It sounds more like it happened under normal operating conditions, not while being cleaned.
But I agree, how did it get out of the machine and into somebody's food? You would think when a guy's finger gets loped off and falls into the food theyd try to fish out the finger (not to mention stop serving that food to the people).

The person who lost the finger has the dominate case by far!
It is going to be a personal property case, perhpas with a little intentional infliction of emotional distress.
The only one who's going to make any money will be the individual who loast the finger.
First from the a-hole who wouldn't return it
second, from the store since they knew this dangerous condition existed and didn't rectify it. (Unless Workers Comp is the exclusive remedy, but it seems this falls under gross negligence)

If I found a finger in my food, and the manager tried to get me to give it to her, I'd be suspicious of her intentions. This guy wasn't in a position to be thinking clearly directly after he discovered the finger. In hindsight, he may be able to see that he could have handled the situation better on his end; but, how is it his fault that the ice cream shop went ahead and sold contaminated ice cream, after taking the owner of the finger from the store to the hospital. They knew that a fingertip was missing. They likely knew where it could be found. The reason this guy doesn't have his fingertip any longer rests firmly on the employer. They should have gone on a finger hunt. I can see Kohl's being hit on 2 sides with lawsuits from both victims.
It would have been the right thing to do for him to make sure he got the finger back to the owner; but, how can he be held responsible under the circumstances. Nobody seemed to be worried about it, until he found it in his food.
