Is dumping/putting a turndown right after the muffler illegal at all?? I am in ny.

heres my dumped set-up for ya

 

basically I have the maggie side exit kit now, and if you look at my posts I have had alot of problems with it, so it is being replaced by the maggie rear exit kit. I don't want to put the whole new kit on yet because we are in the middle of salt season and I have to return the side exit soon. So I figured i install the new rear exit kit and dump it just like the pic above until spring, or if I like it dumped, for good, lol.
