I just needed to know, does this law apply in Canada as well?
if so, do you have a contact or web site with this info? I emailed SEMA but am waiting for a reply.. I knda need this info ASAP...
Thanks a trillion,
Take care man,
Morley

Different country, different government, different law makers!
But you didn't say what it was that you believe is a warranty claim. Is it related in some way to the aftermarket stuff? Are they saying that a specific item has caused a specific problem? Or are they just being stupid?

Hey Familyride,
They are saying that my remote starter could be the cause of the
cd player LCD display not apearing...
They are saying that my AF1 could be the reason why I have a intermittent rough idle.
They are saying that my Ravin muffler couldbe the cause of why I have a ting in the front end.. they called it an engine ping...
It's not a F&^%$# engine ping, its a front end part "ting"
Most certainly not exhaust related..
F&^%$ these dealers are a bunch of F*&^%$#@! idiots.!!
I am sofa kin pissedoff.
Called FOMOCO and told me that my warranty may be void, its going through all the legal crap now..

Tweaker, sorry to hear about the crap you've had to go through.
Please keep us posted on this one.
I know things will vary from Canada to the US, but it's all Ford.
I don't get how any company could void an entire warranty when most of the vehicle remains stock.
From what you are saying you have got to deal with some real jerks. If I were buying a vehicle in that area I wouldn't mind a heads up on how this dealer works.(dealer name, where from)
Hopefully things aren't that much different in Canada and you have some protection from the intimedation.
Good luck, keep us posted. If you need assistance, I would guess some one here could help.

Hi Tweaker
Hopefully the MM act. works where your at....
Dealer/tech/service writer?...saying problems your having may not be covered under warranty because of mods.? Guess that remains to be seen.
Curious...was the remote starter disconnected to see if that was causeing the LCD problem?
Was the stock intake put back on to see if that corrected the rough idle?
Im lost on the exhaust "ting" thing.
What did you get in writing from the Ford certified tech. showing what he did to prove your mods. were the problem? Hes gotta sign and put his # on it.
Something missing here? Stay cool!

Something else you might try although you shouldn't have to, try another dealer. If you find a dealer that is sincere about addressing issues, they'll take it serious and look for the root of the problem and either prove or disprove what is causing the problems.
Otherwise, is this dealer saying they won't even try to address the issues whether it's a warranty claim or not? I mean warranty or not, their job is to fix problems. Too many are lazy and cop out. I'm sure the dealer principle would love to hear that his Service Department is turning business away....

Hi Tweaker,
We've been fine, and it's very nice to hear from you again!
Sorry, but we cannot advise you on legal issues in another country, as we have no idea what the specific laws regarding consumer rights you have there in Canada may or may not provide for. One thing is for sure, don't take it laying down, they will automatically win if you don't fight them.
I can tell you that it's highly doubtful that your modifications have anything to do with your symptoms, but then, you already know that.
Unless you installed the AF1 wrong, it cannot cause that, and if you did make a mistake installing it, it would make itself readily apparent, as it wouldn't want to idle hardly at all, and would stumble upon acceleration, etc.
If it's the same in Canada as here in the US, dealership service departments get paid *far* more to do work when the customer pays out of pocket than they are paid by Ford to do the *exact* same work under warranty being paid by Ford. Its always been that way, and that is exactly why some less-than-ethical dealers will attempt to deny any kind of warranty claim they can, to try and make you pay out of pocket, so they make more money. Few dealers try to play those games, but there are a few.
You need to take your vehicle to another dealer, or get some good legal advice from a lawyer in your country, or both.
The Magnuson-Moss Warranty Act is U.S. legislation, not Canadian, and therefore I'd say it's a safe bet that the MMWA doesn't apply in Canada. However, you may have the same basic kind or even better legal protection, so you need to check on that in your country with a good lawyer, who will charge you far less than the cost of repairs to give you a half-hour of good advice.
Either leave that dealership and go to another for your warranty work, or get the name and telephone number of that Ford dealership's Ford Zone Rep., and take this up with them.
Also, make sure you force the dealer to put this in writing if they are going to deny a warranty claim, clearly stating exactly what your aftermarket parts (and which one has done exactly what and how) have actually done to cause damage to your vehicle. If they can't do that, they don't stand a chance in court here in America, but again, you need to check your own laws and get good legal advice, I'm not a Canadian attorney.
Good luck in Canada!

I just had a thought, if I'm not mistaken, in Canada the consumer is protected even more than in the US. Product warranty provide for more burdon of proof on the manufacture I think.
We have a client that is one of ther worlds largest manufactures of consumer computer products and with those products they are supported in Canada because of the laws around them.
I could be wrong but it's worth looking into the laws of Canada.

Right now I am still waiting for the manager to call me back,
shoul dbe by tomorow hopefully..
I know I was really ticked off when I posted the other day, just had
to blow some steam...
I'm just wondeirng if all the dealers, let's say in a given city have the same database of info,
So let's say I bring my truck dealer "A", then to Dealer "B", would Dealer "B" know about my visit to Dealer A, the day before?
Interesting question...
Still looking for the legal info..

Hi Tweaker
When i took my truck in for warranty work last year...it was my understanding the work performed was entered into the Ford database...
That info is available to other Ford dealers.State to State etc.. Now...has that changed since then, dont know? Seems to me this would also apply to Canada...still FOMOCO.
We all have opinions and as you can see whats been posted, others are trying to help out. MM act appears to be only USA?
So..if that is the case...as posted earlier...gotta see what consumer protection is afforded you there in Canada.
Again...I KNOW...not easy...but stay cool unless you already got the dealer aggitated and they are now hostile towards you. There are two sides to every story, so get everything in writing & make notes, times, dates, etc.....Its just business...I do understand the emotional side...Been there..done that!
I can tell you that all Ford dealers are not created equal...There are some good ones and not so good...I have the paper work to prove that.
In all fairness, i still believe in Ford...77/88/99...3 trucks..but, the bad dealers (svc.dept) ive come across, unbelievable some things done to my truck under warranty.. Ford knows...cause i put it in writing to them... Hang in there, this may take some time to fix.
Good luck....OT

Tweaker, have you been to the web site?
On the web site, clicking on "contact info" will bring you the option of an e-mail address list, for thier staff.
I certianly hope this isn't a losing battle. A battle is one thing. A losing battle is a loss for all of us with mods.
Ford is a huge company. This dealer is a spec in the big scheem of things. They don't have control of this issue!
I might send Jim Keay Ford an e-mail myself.
We're here for you!

Hi Tweaker
The last line of Wittom(Tom) posts says ALOT!
This is a public forum and open to all eyes. However...there is alot of clout here...that was proven with the wrong radiator issue.
Perhaps you choose not to add more to what you've already posted? Or have posted all you really know...point being...im still somewhat confused as to what the tech. did. Tests conducted etc. that lead to your being told that your warranty might get voided?
It may seem like a battle to you, if so, gotta have some strategy!
Keep your chin up. Good luck....OT
