It's here-refusing delivery
 
The dealer just called. My Screw (ordered 3/13) just showed up. I am going to go check it out and inform them of the radiator issue. I am not going to pay one penny until they put in the right radiator or give me in writing that they will change out the radiator regardless of what Ford says. Should be interesting, I'll let you guys know what happens.

Well I just got back from the dealer (Theodore Robins in Costa Mesa, CA)

They basically just said that Ford can change the spec at any time and that they would be getting in touch with Ford on Monday to see what is going on. They made absolutely no attempt to get me to take delivery at all.

I went through fleet sales and I think that they do not have any concern (at least they showed none) about making the sale to an individual. I was talking with the fleet sales manager and it seems he could of cared less.

If they deny me, which I think they most likely will, who is the next person up the food chain that I should talk to?

We will see what happens, looks like a long road. I will let you guys know what happens.

the truck looked great though!

I don't know what I would do if mine comes in w/o the 1.42.

I hate to think I was shorted, but also would hate to have someone tear into my brand new truck.

Then there are some posts that almost make me think the 1.01 is the new standard.

When I ordered the truck the dealer said "it will have the correct radiator in it".

I am thinking I will take it and run it till theres a problem.

The engine will run on 4 cylinders while the other 4 pump air to cool it so you can get somewhere safe, I understand.

I just posted the following on another thread when asked why deposit or downpayment should be made with a credit card rather than bank check or cash....here's what I said, and this might be good for your problem.

...ALWAYS pay downpayment or deposit with credit card because if merchandise or service is not received (if you back out of the deal) or if the merchandise or service is defective, you can return it or repair it elsewhere (proof of defect) and not be liable for payment. Added bonus...credit card company hassles company seeking payment from you, debits their account and makes them prove merchandise or service was received, and received in good order.
When I signed a dealer agreement for a SCrew in December 2000 and found that the vehicle was defective the day of pick-up, I refused to accept delivery. They laughed and said I owned it, come pick it up or they'd have it towed off the lot. Then, when I cancelled my $6500. deposit, called VISA and told them the merchadise was defective and refused, along with a copy of that letter to Ford Motor Credit advising I would not be paying the loan....I got several calls...from the dealer begging me to discuss the situation!!!! Paying by credit card provides LEVERAGE...and that's a good thing!

Good luck and get what you paid for.. we all work too damn hard to be cheated....

I don't think they can legally withhold your deposit. I never signed any document saying I was going to buy the truck. The dealer still owns the truck until you sign on the dotted line and get it registered. So having it towed would only cost the dealer money. I have a friend that bought a car and then realized two days later that she couldn't afford it. She took it back to the dealer and after lots and lots of arguing they took the car back.

I will just keep on pushing and pushing until they give in. IF they don't give in, well I have lots of time on my hands so I am sure I can do lots of things to make the dealer wish they just changed out the radiator.

Sparker, Relax they haven't even cashed your deposit check. You can go in tommorrow and they'll hand it back to you. All vehicles ordered belong to the dealer untill they sell them. Your deposit is fully refundable. When I picked up my ordered truck, they had the bank check for $ 500.00 I gave them as a deposit 8 weeks earlier in the folder with the other paperwork. If you went in to buy a truck off their lot, and the next day decided not to buy it, they would give you back your deposit. When I ordered I didn't sign anything either. It's their truck and if you don't buy it someone else will.

MrBill is right about using your credit card for the deposit BUT my Ford
dealer does NOT accept credit cards
for deposits, they want a check (said they
wouldn't cash the check).
I wanted to use my credit card to have the protection it provides, so I used a check
provided by my credit card company.
They did cash the check the next day, even
though I was told they wouldn't.

I agree with MrBill on this one ~~ use your
credit card.

Just do like me...refuse to pay a deposit. When I told them that I refused to put any money down an item that I havent even seen yet they said they were sorry but this was their policy and that they required a deposit. I told them no thanks and hung up. 20 minutes later he called back and ssaid that they would sign a form stating that if I didnt accept the truck for ANY reason that my money would be refunded. I told them still no good and hung up. About 10 minutes later the sales manager called me and said they would be happy to order my truck with only a "handshake" as a deposit.

Just stand up to 'em and dont back down. If they really want your business they will bend.

The dealer called and has informed me that they have been in touch with Ford and that Ford has changed the spec. on the supercooling system and that I have the correct radiator. I told my salesman, Get it to me in writing from Ford signed by someone.

He then said "You want me to do it? Can't you just call them?"

What a joke. He said he is going to go talk to his general manager and get back to me.

I fully expect them to give me a take it or leave it answer. They have not made one comment on taking delivery of the truck. It really does seem like they don't care. Business must be good.

If I do take delivery what can I do to bring this up to Ford. I want to deal with Ford directly, is it possible with out going through the dealer? I need some help, who is the next person up the food chain, district area rep? Who should I start writing letters to? Can I take Ford and/or the dealer to small claims court in my local county? If so, who has to be put on the paper work when filing, the dealer owner? (how would I find this out) what about ford, do you just put Ford Motor Company with an address or do you have to put a specific person at Ford? Any lawyers here want to give me some pointers. I just need a little direction to get me started. Any help is much appreciated.

If your dealer has a PC with internet access, go to your dealer, go to the Ford web site, and go through the Build and Price process. Also point out the Super Cooling in the brochure, in the manual, and elsewhere. Ask him if this looks like a spec change to him, and inform him that they cannot legally change the spec to remove an extra cost feature - they can't decide to give you the 4.6 when you paid for the 5.4, and they can't decide not to give you the radiator when it's clearly part of an extra cost package.

Of course, since you haven't bought it yet, if they tell you they won't switch it, you probably either have to put up with it or go elsewhere.

I have all ready showed all the information mentioned to the dealer. There comment was that Ford can change the spec anytime they want. I should hear from them tomorrow some time. I need to get in contact with some one from Ford and not the dealer. Any suggestions?

Detailed specs area available, the service department should have whatever you're on the lookout for. Ford, and every other vehicle manufacturer, issues service notices whenever an official change of specification is made.

No doubt it is cumbersomesome...there are only two categories to describe this type dealership....1. Lazy or 2. Lying

You might try calling Ford with the vehicle ID...ti's amazing the amount of detail they have on-hand. Good luck.

Just got a call from the fleet sales director and they are going to be changing out the radiator. Should be ready for pickup thursday.

I haven't checked it out completely so hopefully there is nothing else wrong when I show up to take delivery.

Of course I still am not going to believe it until I pop the hood and see it for myself.
