Richard,
I guess you'll have to change to sig. pic.

At the bottom of the page with your picture, it says;

No portion of this page, text, images or code, may be copied, reproduced, published or distributed in any medium without the expressed written permission of the copyright holder.

If you look at the pictures he just grabbeed a bunch of cool photos of Lightnings.. and posted them.. Dont think he intended it to look like that was his truck... He also has a bunch of the Ford Publicity photos up there as well.. Since yours was included it should be a compliment.

Konig,

Give the guy credit. He took the time to set up a website to display pictures of Ford performance vehicles. I applaud the guy for talking the time to do it. It's obviously in the very early stages, but in time, it might be a cool place to check out some cars and trucks.

I'm not sure what the internet law is on using pictures, but you see it all the time on this forum alone where guys will grab pictures all the time from somebodys sight and post them on here. I think once it's on the internet it's kind of like free game unless you are infringing on somebody's trademark and using it for profit.

Tell Brian that he has the site has promise. I will be happy to send him a few pics in about 4-6 weeks once my project is done.

I have a friend who took a class that they talked about internet copyright law, and I believe what he said was that when something is placed on the internet it is the legal property of the person who posted it. Since it's so easy to just right click and save a picture however, there isn't much that can be done to enforce. So is it legal to take a picture that's not yours? No. Will you get caught? Probably not.

-Note- This might not be entirely accurate, I don't make any claim to know anything about this at all, so please feel free to correct me.

I'm an intellectual property attorney who is pleased to inform you that your analysis is entirely correct.

Copyright attaches upon creation, not registration. Registration only allows certain remedies not available for unregistered works.

This post--as I'm writing it--is copyrighted by me.

The thing about the Internet is that a good argument can be made for implied permission to use. For instance, if someone does a "quote" reply, they have copied my work. That is infringement. However, a strong argument can be made that I implicitly consented to this use in this forum.

The images on my Web site are maybe 50% mine. However, wherever possible I try to give credit to the author. In the case of commercial images, I usually provide a link to the company. Yes, I am committing copyright infringement. But I have not had a complaint yet, as I am hopefully bringing business to the companies.

On my Web page with jpegs of recent magazine articles, I posted the following notice: "Notice to copyright owners: These articles are reprinted for discussion on the Lightning forums. Hopefully these articles will increase, rather than reduce, the demand for your publications. Should you disagree with an article being posted here, please contact the Webmaster and your article will be promptly removed."

For non-commercial images, the reality is that no one will sue. Statutory damages--that is, damages that a court can assess without proof of loss--are only available for works registered with the Copyright Office prior to the infringement. Thus, for a noncommercial image, the plaintiff could not prove any losses to be compensated for or any profits wrongfully obtained by the defendant. I.e., no harm, no foul.

So you were right on the money, Bozman42.
